EA just doesnt give a damn

Was using a well recommended EA to sell our house, family and friends suggested them and were happy with their fees etc. Anyway, we got a buyer for our house and ever since, the EA has been really hard to get hold of, ignoring our calls, not filling us in on problems in the chain and basically he couldnt care less. Now the guys in the office all own the company, each has a share of the business so you would think they would bend over backwards to get a sale? Wrong, they are useless so we have dumped them and just going with buyer through solicitors (buyer is family friend)
I would of thought with house prices as they are and not having many sales lately, they would pull their fingers out and try and make some money?

Different estate agents have different ideas when it come to progressing a sale. I know one high end agent who doesn't feel it is their job to progress a sale, its the job of the solicitors involved. Other agents will chase a sale at least once a week. It seems you have the former.0

Okay, the way you worded your initial post it sounded like the buyer was found whilst you were still with the EA. In that instance I think you would find that you are still contractually obligated to pay them.
If your buyer really wasn't due to them, or made any enquiry via them, you should be okay.0 -

I wouldn't be surprised if the EA still try and claim their fee!!
How did this friend discover the house was for sale? Did they see the for sale sign outside? Did they have any contact with the EA whatsoever?Should've = Should HAVE (not 'of')

If your buyer did come via the estate agent, they have a legal right to be paid a fee.
I would however haggle on their fees as much as you can, due to poor service. Perhaps sell the idea of a fee reduction to the agents like this....
If they'd properly progressed the sale of the original buyer properly, you may not be in this situation. Meanwhile, you have had to pay further mortgages payments whilst waiting for a second buyer to come along.
As you are out of pocket and its only fair the estate agent accepts a little liabilitly, admits poor service and reduces his fees accordingly.
