Hey,
After trying to prove that ex's debts are not mine, I have had a visit today from the most horrible and threatening man I have ever met in my life. I am disputing debts in my name as they are nothing to do with me (I did not open them or sign for them) and after sending CCA request letters Debt Agencies cannot provide me with a signature or proof to say that they are mine. Please can someone advice if the letter below is the correct next letter to send?
Dear Sir/Madam
I DO NOT ACKNOWLEDGE THIS DEBT. I have already explained this in a letter that I wrote to you on ********** via recorded delivery, where I requested a true copy of the signed agreement under the terms of the sections. 77(1) and 78(1) of the CCA 1974, that you state I have signed, enclosing the statutory maximum fee of £1 in the form of a postal order.
You have not provided me with a true copy of any signed agreement as requested under the Consumer Credit Act and I have not been provided with a true copy of the deed of assignment, despite my properly formatted and paid for request within the timescales permitted within the Act.
Moorcroft has, I believe has committed a criminal offence under the terms of the Consumer Credit Act, and non compliance with the original request is therefore a complete defence to any court claim that may be issued.
Also under the Data Protection Act, you are breaking the law by discussing an account with me that does not belong to me. Any further correspondence from yourselves or any agent on your behalf shall be deemed as harassment and in this case I shall contact the Police, The Office of Fair Trading and The Financial Ombudsman.

I really need some help because I don't know how to sort this situation. I can't get in touch with my ex, the Police have been in contact with his family and they are denying knowledge of his whereabouts and the police are now saying that it is up to me now to prove that these debts are not mine - please help x

Hi yes as far as i know this letter is the one that you need to seed off, Have you contacted the CAB? the number will be in your local phone book. These people will be able to offer allsorts of help. If anyone else come dont let them in tell them its not your debt and that you dont kown were the person is whos debts thay are. dont answer or say anything else if that threten you say that you are phonr the police. stut the door and phonr them. Thay can not come into your house unless you invite them in. If thay wont to come in other wise then thay need a court order and the police with them. If tahy wont a court orderb tehn thay have to aplay to the courts. in which case you will have a letter of the court asking ypou to atend the court. ther you can state your case.

I really just don't know this can be happening. I've never had bother like this and up until only recently knew nothing about this, now I have people at the door and its not even my debt. I have phoned my local trading standards office and they advised me to contact the police, which I have done. I will get in touch with the Citizens Advice tomorrow. Its all just so scary

your not alone rainbows we are here for you where is your ex by the way if they are his debts can you not send folk his way soory to pry but why shud you have the hassle0

Thank you, everyone seems so kind on here. We did live together and he did make a number of purchases not too long before we split but he said they were on his card and of course he took the items with him when he left. I have only started receiving letters and statements from catalogues which is when i found out about this whole thing. I have no idea where he is and when I contacted he family they wouldn't entertain me. I have been in contact with the police and they have been in touch with his parents too but they reckon they have no idea where he is. I've explained the whole situation to Moorcroft and they are not interested at all. They said that debts are in my name therefore they are mine. I've asked them for proof of my signature and proof of my signature against the items they are saying that I have had delivered and they can't provide anything yet they are still hassling me. The thing is when that guy was here earlier, he was threatening to take my dog because she is a pedigree and i really just don't know what to do. I've spoken to my parents and they have said that I can move in with them and they won't anyone near me but I don't want to bring all this nonsense to their door either. I'm listening to everything that people are saying on here but Its just really frightening.0
