  • jesus you are going thru the mill sodding men!!! did the guy have correct papers to enter your property have you actually been taken to court you say they haven't even provided proof so the answers to those are no you really need some legal advice hun i wish i could help the cab is a good start though you are being harassed and hounded you have a right to fight back. i lock my door and look thru window if i don't know them i don't answer if they come back phone the police while they are there don't open your door hun am really worried about you
  • moorcrof thave been mentioned on here earlier by a man who was threatned to have his garden gnomes taken the collector tried to force his way in too its seems they have had a night of it we have moorcroft as a creditor so hope they dont come for me

    Hi Rainbows, sorry to hear of your trouble, can't comment on the letter (tho looks good to my untrained eye!!) but had similar trouble from my ex too!

    All I can say is, as long as your signature isn't on the agreement you are not liable whether you were married or not.

    Also, if you haven't done it already, get onto Equifax, Experian and the like and get a disassociation (sp.) done between you to separate your financial affairs and credit record from your ex. It will save you a LOT of hassle and stop him seeing your credit file if/when he does a search. It may cost you a few pounds, but possibly save you a lot of trouble, just give them a ring and they can send you the appropriate forms.

    Send them this letter by RECORDED DELIVERY:

    Please be advised that I am only prepared to communicate with XXXXXXXXX in writing. OFT rules and regulations clearly state that you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you.

    There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; e.g. the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.).

    Therefore take note that I revoke license under Common Law for you, or your representatives, to visit me at my property and if you persist in sending "doorstep callers" to my home, you will be reported for harassment and be liable for damages for a tort of trespass.


    You would also be liable for conspiring in a tort of trespass by acting in defiance of my instructions and sending someone to visit me nevertheless.

    Should it be necessary, I will obtain an injunction

  • I didn't let him, but he was really vile - just a horrible horrible person! Moorcroft are threatening me with court action but haven't done it yet. The thing is they sent me a letter saying that they could not provide proof of my signature on a credit agreement but then sent a letter a few days ago going on about litigation (i assume that means court). I'm going to send that second letter tomorrow to see if that makes a difference. It kinda worries me tho because I need to have criminal record checks carried out for my job and I'm scared that all this will have an effect on my job. Think am just getting all stressed with it all :(

    Hi, sorry to hear about your situation it realy is scary. My best advice would be to check out www.consumeractiongroup.co.uk there are lots of experts and wont be long b4 someone points you in the right direction. Good luck and keep us posted.

    I've explained the whole situation to Moorcroft and they are not interested at all. The thing is when that guy was here earlier, he was threatening to take my dog because she is a pedigree
    Moorcroft are bullies, once you know how to deal with them, they'll back off.

    If anyone else turns up on your doorstep univited, inform them you have secret CCTV and they're being recorded (even if you don't) then close the door.
