http://www.sexynightwear.co.uk/ - No item, no refund

Made an order of £60 from these on 3rd October for a costume for wife in time for halloween. Paid via google checkout, order was received all well and good. Had an email to say the item had been sent on the 6th.
After a week it hadn't arrived, so I phoned to checkup, and they said it had been sent and would look in to it and call back. Another couple of days and no return call so I emailed (to which no response), and then phoned but they still didn't know anything.
Then had an email on the 21st to say the item is out of stock and I would have a refund, which is fair enough (although why say it was sent  )
Gave it a few days, and no sign of a refund, so dropped a polite reminder. Still no reponse, so sent another email beginning of Nov. Still no reply, so tried phoning, it rings once then the phone (which is a mobile number) goes straight to answer phone.

Wish I used a credit card now!

most of these sites are "drop shippers" , they do not hold the stock but get it sent direct from the wholesaler to you.

£62 with delivery. Not a shocking amount but its still theft if they don't refund.
Thinking about involving the SwC courts. It costs £80 right? But if I send the papers after paying my £80, and the other side refund my original £60, do they pay the additional £80? Forgive my ignorance, its not something I've ever looked in to.
