Advise on what to claim please.

Hi all, so I recently seperated from my wife and she has gone to stay with her Mother for now (I have agreed to leave home after xmas), I have 2 teenagers at home with me and I have a mortgage, I applied for Income support and was declined as I do not have control of Child benefit payment and my wife will not give it up and have been told it could take months to get it changed over, I have claimed JSA but £60.50 goes no where as you can imagine, I visited the Doc's last week and was referred to the hospital and was seen within a few days but will not get results till after xmas, the Doc has given me a sick note for 4 months, first question is do I switch to sickness benefit as I am unable to work? but need to get back 2 work, will I get help with my mortgage as originally taken out in 1993 but switchen in 2005?.

Any advice appreciated, cheers.

    Your wife is illegally claiming child benefit as the children are with you. You need to contact child benefit and tell them what's going on. It doesn't take months to change it over.

    Also if you're in receipt of tax credits, make sure she's not getting them or at very least the CTC.
  • Hi Conor, I have filled out and posted my claim for CB and have changed the CTC which has gone down by £20 a week even though I have less money coming in I intend ringing them after next payment is received.

    don't hold your breath on the CB being sorted quickly.

    I applied to have it re-instated when DS went back to college on 1st September, and about 3 weeks later received a form wanting his course details. I completed that and sent it back within 48 hours -- only to have another one arrive this morning !! Phoned and asked why, and all the chap could say was that "they probably didn't receive it". So I need to complete it again and send it back (going recorded this time, though I can't really afford to pay the extra), but even then they can't guarantee when I'll get any money. I was told the guidline they have to give is "at least 4 weeks from receipt of application", but I was told last week this was "within 4 weeks". Today's message was they're currently taking 5-6 weeks for simple applications........

  • Hi, as I'm only here until the new year was going to leave CB as would save a lot of arguments but done it now anyway.

    Your ex-partner needs to write to CHB to advise she wishes to give up CHB and this will speed up your claim. I speak to CHB regularly and they quote 6 -12 weeks for a change.

    CTC - this is normally paid to the person in receipt of CHB. I take it your ex is no-longer on the claim? Technically CTC should stop until CHB is awarded in your name.

    Lastly there are new rules for claims to I/S from end of Nov, basically there is no entitlement to claim if the youngest child is over 12 years of age.

    If you are not well enough to work you should claim ESA with GP certification.

    Mortgage requires 39 week qualifying period unless you have been abandoned.

    All abit messy to be honest. Who will have responsibility for the children after xmas?

    Hi, my wife will be responsible for the children after xmas as I have agreed to move out, yes very messy but you just kepp plugging away, every day is a new challenge.
