What are her rights over the house?

My sister and her boyfriend have split up but own a house together that they bought a couple of months ago. Could anyone give any advice on her/his rights.

My father put the deposit into the property and the rest would all have to be paid back to the bank to repay the mortgage as they have not had the house long. So there is no financial benefit to him staying although I think he thinks he can keep the house as an investment. She does not want to live in a house where her ex can come and go as he pleases.

Can anyone suggest or have any experience of a way out of this type of situation. At the moment he won't leave the house and won't accept that its over (even though it was him that cheated on her I might add!). The situation is desperately sad and there is a child in the house (not his) and they cannot continue like this.

Looking forward to hearing anything useful anyone has to say.

    There is nothing your sister can do to force him to leave the house. I think first thing is he needs to accept that its over. Can he afford to buy your sisters share of the house? If so that could be the cleanest way out.

    As for your dad's deposit, unless there's something written down about what happens in the event of a breakup then I'm not sure there's much that can be done.
