NatWest "cannot locate" my Loan paperwork
Hi I wonder if any of you guys can help me. I have two questions really, one which probably should be posted on the PPI thread but its best for me to keep the questions together.
1. I have been trying (unsuccessfully) to get my bank (Natwest) to give me a copy of my original Loan paperwork. After numerous calls to them and promises that it is in the post or that I will receive it "this time next week" it has now transpired that they "cannot locate" it and need a further 14 days. If this paperwork never materialises, what are my rights? Am I able to negotiate with them seen as they cannot produce any documented evidence of the repayment agreement including interest and PPI charges? I presume that they will be able to prove the amounts they have loaned in the past but as they have no documented evidence that I ever agreed to what they are charging etc can I argue this?
2. Is it possible for me to claim for PPI payments from loans that have been settled. i.e. I have refinanced several times and each time Natwest settles my previous loan and sets up a new one incorporating the past debt. I am hoping to try and claim as much PPI back as possible as I was never informed this payment was optional and only discovered I could remove it recently, also I was not fully aware of the level of cover and (perhaps rather foolishly) believed that if I was unable to work that my loan would be settled in full.
I would be grateful for your advice.

What dates were your loans... If they were over 6 years ago then its up to the company if they sent you details of these loans...They have to keep records for 6 years and if they are settled loans and settled over 6 years ago then maybe they do not have them.
You first need to write to the loan company.
Just take a look at the link here and see what you can add and delete from the letter that you send. There is also a template letter on there too but sometimes it can be better to make your own up from this.
You then write to the firm that actually made the sale of the PPI to you if this is different from the lender and don't forget to send this recorded delivery so you always a proof and dates etc.
After that you have to give them 8 weeks for a full and final response. In this time it is usual to get a response of "sorry we sold this to you fairly" but you then respond to this and reiterate your complaint again. The next time they write they either give you a final response which you would need in order to take this complaint to the FOS or offer to settle.
