    Exactly the same happened to my 15 year old Brother in law, i started a thread at the time. He was the first person to be taken to court in our area through riding a mini moto where he wasnt allowed. he got 6 points and a fine for his trouble, cant remember how much.

    that was a petrol moto though

    This also was a petrol one and he was the first, and only if I am correct, one who has been taken to court in our area.

  • The Sheriff didn't even know what he was able to do and had to adjourn court to find out before giving the 6 penalty points.

    Thats quite normal. Magistrates have no legal qualifications at all, and very often no legal experience. They have no idea what penalties are justified and so base their decision purely on what they personally think. So, if you are the local vicar you`d probably get let off, but a 15 year old kid is instantly assumed to be some cider swilling lout who is always causing trouble.

    The only saving grace is the clerk of the justice who is legally qualified and is supposed to advise the magistrate on what sort of penalty should be imposed.

    In my case, the magistrate was considering a ban... even though i was only slightly over the speed limit. The clerk said it was a bit excessive, so the magistrate dropped it to 8 points only to be told again that was a bit much, so they finally settled on 6 points - even though most people only get 3 points for being 4mph over the "allowed bracket" - which is 10% of the speed limit + 2mph.

    Not being a legal expert, you have no idea of how to object to this, or appeal or even present your case. Unless you are rich enough to afford a lawyer!

    Personally, I want to discourage my boy from ever getting on a motor bike - full sized or miniature and that's from someone that considers himself very lucky to be alive after coming off one.
