Thanatos should I appeal?

I have arthritis and have been refused DLA both parts. They said I can walk 200yds even though I told them that I am in severe discomfort as soon as I stand up. Shoud I bother appealing?

Yes I would appeal you have nothing to lose, I did and it worked for me. Good luck.
  • They said how far you could walk?? How did this come about?? When you apply they ask you how far/if you can walk??

It's possible the OP had a 'medical examination'. 'They' did that to me when I first claimed. Decided that I could walk well in excess of 100yrd without pain when they'd only seen me walk around 25 yrds in total over 2 or 3 seperate instances.

If you can't stand without pain, then do appeal. If they turn you down on appeal, then request a Tribunal. You're far more likely to be awarded DLA if you attend in person, than if you do it in writing.

Sorry, I realise I'm not Thanatos, but I believe that's the advice that folks are generally given.

    .

Same for me on my assessment I was able to walk the lenth of a three seater setee, but the copy of the report had me walkig 100meters in less than two mins. Heck I wish I could that far full stop.

    Hi,

Sorry for the delay, I have only just seen this thread!!

If a specific distance was given, its extremely likely that the DM was given this figure somewhere in the medical evidence.

Do ask for an appeal straight away, and ask for a copy of all evidence used in making the decision. This will tell you who it was that said you can walk 200 meters, or if no one did. If no one did, and you have evidence backing up you walking problems, you should have no problems at the tribunal.

If you see who said 200 meters in this copy of evidence used, approach them and ask them why they said it and point out your problems. Then ask if they would be prepared to revise their assesment and send that in. If they refuse, then find another medical expert who disagrees with them and you should be ok ;)

    Good luck with the appeal!
