new benefit/ib thingy confused

a few weeks ago i received a letter about this change of benefits, it said i had to apply for IB by 27th october, i phoned them and went through everything, the lady said it probably wouldnt affect me, then yesterday i received a letter saying i did not qualify for IB because i had not paid enough national insurance in the last 2 years - then today i received a letter from income support dated 1st november, saying my claim has been refused and i must send them a certificate before 10th october ? on checking my account, i found that i had not been paid my income support - please can you tell me what i have to do now. i have never had to send certificates since about 6 months after my chemotherapy ended, the doctor gave me a cert to give in on it he stated he could not forsee a time that i would be able to regain use of my upper body.

i receive income support with disability premium, dla for care and mobility, child tax credits and child benefit

i have not worked now for just over 2 years, following breast and chest wall cancer, i had a full mastectomy and partial removal of the chest wall bones, and the chest muscles removed, this has left me with very little use of my top right hand side.

sorry but i am very confused.

    You got the letter because you have a DP premium and (I think) you are a single parent.

    Once IS ends on grounds of being a SP, if you claimed ESA (the replacement for IB) you would be worse off by approx £1.85 per week.

    These changes to IB/ESA were implemented on 27/10.

    Without checking the guidance I think you would be exempt from the Lone Parent changes anyway as you receive DLA Care element...

    IS as a LP would be due to end between March and July 09, however as stated in my other post I think you are exempt due to DLA

    why do you think they have stopped paying me now, the cert they wanted by 19th october but didnt write to me until 1st november.

    No... I just had a feeling!!

    The situation is... you will have been getting IS with an underlying entitlement of being a lone parent. However, due to the changes in IS coming in at the end of the month, your IS entitlement will cease unless you have another underlying entitlement to IS. With you having a disability premium (DP), JC will have sent you a letter to basically say... we appreciate you have health problems (hence the disability premium) so to carry on with IS you will need to claim IB before 27th Oct. The reason is... IB/IS will still pay the DP but ESA does not...!! And although the letter says you will not get IB, you will be awarded IB credits which is your new underlying entitlement to IS...
    So... for now you will have to provide a med cert(s) until you have a PCA, & then you won't need to send anymore.

    I know it sounds a bit 'a*se about t*t' but just persevere & your IS will continue... just get your med cert in asap....

    Hope this helps... any questions, just ask!!

    To be honest I don't know, I suppose that it's possible IS have been told by IB that your med3 has expired and IS have not checked your underlying circs of entitlement.

    I would ring them tomorrow and enquire, I'm sure you'll be sorted by the end of the day.

    This is not quite right. If she is already an LP the changes with regards to I/S ceasing on grounds of being an LP will take effect between March and July 09 (when the WFI is due).

    Agree with rest of your post but think she is exempt from LP changes due to DLA anyway...

    Don't panic!!!!!

    PCA is a medical... but not as scary as people make out on here!!

    Just get your GP to give you a med cert (sick note) for as long as he can, sent it in... oh, and ring (as previously suggested) to check why your IS was stopped too early...

    They won't be stopping existing IS claims until next year (from Feb to the summer on a 'rolling out' basis depending on child's age) so you should have a bit of time to get sorted...

    And, unfortunately, DLA does not exempt you from the changes... DLA only exempts if your child is getting middle to high rate care component (hence you would be then classed as a carer!)
