Argos - falsely advertised?

I just reserved this online for my son for christmas as I have also bought him the Tag reader:

I presumed it to be the Cars one AND the Diego one as stated but when I collected it I only got Cars. I pointed this out to the sales assistant who checked the website but couldn't come up with an explanation and was very unhelpful.

Would anyone else expect to get both? Should I complain?

  • Yes I agree I think the ad is very misleading as it only gives you one item number for both products so I would have presumed to have got both, I would print a copy of the website page and go back to argos and ask to speak to someone a bit more senior

    If I was buying that I would definitely think I was getting both!

    That advertisment is for Cars AND Diego. They normally state "only one supplied" when there is a choice. I would complain to the store manager and if no joy then Trading Standards. They have taken your money and not supplied the goods advertised so they are in breach of contract. If they say it is only for one game then it is a trading standards matter for misleading advertising.

    I've called customer services and the first lady said it should defiantely be two books. I got transfered to a second who admitted its an error on their website but said they don't even sell the Diego book and that I should just take the Cars one back for a refund! Is there anything else I can do?

    you can't force them to sell you something they don't have. (unless you want/have the money/time to try to go down the route of specific performance enforcing the contract?) Might be just a little disproportionate though?

    if you are nice, maybe they'll give you a £5 voucher off a £50 spend or something for your troubles?

    Now that you have pointed out the error, I understand that it's Argos's responsibility to correct the advertisement. If they don't do this pretty quickly I believe they would be in breach of the Trade Descriptions Act and can be reported to Trading Standards.

    As far as your rights - you can either take the one book for the price you paid or return it for a refund. You don't need to accept a credit note.
