Capquest

I received a letter this morning from Capquest saying they are working for Capital One and want a payment from me of £4531.51 within 7 days. I simply cannot pay this, it says in the letter if I can't pay it to contact them. What should I do? I'm really scared because I have loads of other debts also.

    Do not telephone them.

    2nd thing

    have you spoken to e debt charity about your financial situation?

    3rd thing

    When did you last pay money towards this account? What sort of debt is it?

    I've not spoken to a debt charity yet but am going to phone CCCS.

    I'm not sure when I last made a payment but would think it was 6/7 months ago. Its a Capital One credit card.

    I took it out approx. November 2002. I honestly can't remember how I took it out think it was a form that came through the post that was half filled in and I just signed it and returned it.

    Have you requested the Consumer Credit Agreement

    No do I need to do this? I'm not sure what this is

    The form you signed may be a Consumer Credit Agreement, or it could just be an application form.

    if they did not issue a proper Consumer Credit Agremeent, then the debt is unenforceable in law.

    You need to request this and if they do not have it, then they canoot take legal action to collect the debt.

    I had a letter from them regarding my Egg Loan which I was paying to Moorcroft but seems it was sold on. It was the same - demanding £6K approx. and saying I only had 7 days to pay and it had solicitor and court fees added too.

    I rang them up, advised I was paying £80.10 to Moorcroft and thats all I had and they accepted that as an ongoing payment to them.
    Total Debt now £22,525.07 Start Debt £32,732.36
    £10207.29 OF DEBT PAID OFF:j 31.18%

    Hiya sweetie

    I agree with RAS - do not phone them. Capquest will threaten all sorts but you can't pay what you don't have. You can go the CCA route as RAS suggested and that will give you some time. There are sample letters on a thread on this forum - just do a search for 'CCA updates requests'

    This will 'buy' you some time. The next step is to get on the phone to one of the debt charities, CCCS, Payplan or National Debtline. I used the latter and they were so lovely. You have to tell them about everything (and I mean every debt!) in order for them to give you proper and appropriate advice. You will feel sooo much better when you have done this!

  • I sent off my letter to Capquest requesting a copy of the CCA and this morning I have received a letter saying that my account is now on hold for 28 days. What does this mean in relation to the 12 days that I specified in my letter?

    Letter from capquest is initial standard response I think - I had that when I CCA'd them. They then followed it up quite quickly with a response to the request.

    Did you request a copy of the notice of assignment ? This confirms if they are acting for the OC or have purchased the debt .
