DLA backdated?

I don't think you would be able to get your award backdated,as it was declined on the basis of the information you submitted at that time-they therefore made the correct decision for that claim.(this is what I was told about my son's failed claim last year but someone may know better and will put me right if I was informed incorrectly.) This is why it is so important that claimants get advice prior to completing these forms (which lets face it,are a nightmare!)

Write a letter to the dla section who awarded your benefit. Explain in great detail about your need to be transported horizontally etc. and how upset you are that the decision maker hasn't taken into account your particular circumstances viz. how bad you are in terms of your (virtual) inability to walk and the extreme unlikelyhood of your recovery in two years time and that getting even one more year (or 18 months to make sure) would be of so much benefit so that you can get a motability car and be able to get about.
PLEASE be aware that they may look again and your award could go down, I don't know your circumstances but have used this method successfully before.

The only way to get the DLA awarded for the period btw Jan and April is to now submit a 'late' appeal. This involves completing form GL24 which asks for details of why you thought the decision was incorrect. As you are outside the one month time limit you will also have to state what the reasons for lateness are. This can be stating that you have been very ill etc but you can also state that your case has 'a reasonable prospect of success' and it may be allowed.
Supersessions are where the original decision is superceded to take into account a change of circumstances. For instance if your care needs increase you may wish to seek a supersession on the care compoenent of your award in an attempt to be granted one of the higher rates. A nil entitlement award cannot be superceded however so your only option now would be a late appeal.0
