Hi guys,
Just booked the BR date. Dec 1st, bit of a wait, but makes me think I am not alone in going BR. Thanks for the letter, might have a bit of fun myself penning one. let me know how you get on GettingHopeful, be interesting to see your letter. Getting nasty letters from secured loan co, so be great to tell them where to go when Dec 1st comes. I know the SL co have to wait until the sale of the house, but hey what can they do? will be floating high in the clouds by then. debt free0 -

Hi, well this is my first attempt, I do waffle on a bit.... My mortgage company wanted various bits of info that wasn't in Scarlett's letter, but thanks Scarlett, gave me a base to use:
Dear Ms XXX,
Following your letter of 31st August, I have now spoken with your department a number of times regarding voluntary repossession of the property.
Your officers asked me to obtain independent legal advice before proceeding . I have now done this, and as per my calls of 14/18th October, confirm that as I am now in secure accommodation and that the Official Receiver has no objections, there are no further considerations from my point of view.
The form which was to be sent to me, has, unfortunately, not been received. I am therefore enclosing the keys, and hereby surrender the property to you for voluntary repossession. I confirm that it may be sold to recover monies owed to you from the mortgage and necessary expenses.
The property is vacant and unoccupied and I have removed my possessions. It is secure and tidy. The electricity has been switched off at the mains in the hall, and the water from the stopcock in the kitchen. The flat is not up for sale.
Any money left after sale should be forwarded with a statement to the Official Receiver at XXXX. If there is a shortfall, the Official Receiver should again be informed as this will become an unsecured loan against my estate in bankruptcy.
The building is insured through the Managing Agents, XXXX who have recently contacted you (please refer to Mr XXXXXX in your Securities Dept).
The deeds to the property are held by solicitors who acted for me on a sale that did not proceed. They are Mrs XXX of xxx. Mrs XXX also has the Managing Agent’s Buyers Pack, for which I paid, and which can be used for another purchaser.

Looks ok to me GettingHopeful, but I would let the experts here cast their beady eye over it. Like you I will take bits of Scarletts letter as a base. Did you neogiate a date to hand over the keys or did the mortgage Co give you a date?0

Hi Dodger,
I haven't negotiated a date. I have rung lots of times, and its been agreed in principle, now I've got other advice OK, but I was waiting for the forms, and am now fed up with waiting as have the council and elecricity co on my back, plus management co, bits of continuing expenses, that I didn't think I would have to pay.
So am simply going to send a letter with keys off by special next day delivery, probably Sat.
Just a bit worried something might happen to flat over weekend or something. Don't know whether to get a third key cut just in case.
What are your circumstances.Bankrupt 11th June 2008
