anyone here work in housing benefit?

me and my husband tried applying for housing and council tax benefit last year when he was out of work for 3 months. they asked to see 3 months of bank statements to see my DLA amounts and pay etc. at that time my husband had 2 savings accounts that we transferred money to on a monthly basis. one lot was £250 a month to his isa which was used for our family holidays which had about £1300 in at time and the other account was £150 a month into to help towards christmas expenses. this we did not use for a while and had built up about £3000 which was withdrawn 3 months prior to us applying for benefits but now had only £450. after many weeks of waiting for a response they finally wrote to us asking where the £3000 had gone i rang them to say if they looked at my current account statement they would see it had been transferred in there to cover us being nearly £3000 overdrawn. they went on to ask us to show books etc and we decided as he was now working it was easier not to bother HOWEVER a fortnight ago my husband left me and took both savings books that were in his name anyway and two £200 withdrawal and even transferred our £3000 overdraft into his savings account. i have been told i cant remove his name from the account or close it without his signature and since leaving he has not been in touch and wont answer his phone i am now back to needing to apply for both housing and council tax benefit. i am opening a new current account in my sole name which i can obviously show the benefits people but will only have small amount in it just my benefits but little transacions and so will have to show 3 months of our joint account statements again showing cash withdrawals and money being transferred to 2 other accounts. NOW obviously i cant say where cash has gone and cant show savings books as he has taken them. will they just accept this or refuse to help or ask for something else i cant show. what do i do for the best?

They might well still have the records / copies from the last claim, so you can show that the amounts going out of the joint a/c have gone into the a/cs in his name.
They won't ask you for proof of a/cs that are in his name only.

    Apply.

we never got to the stage of showing other savings books as once i had got off the phone and told him they wanted to see them he decided he would rather drop the claim. i guess what i need to know is if i show them statements of an account i am no longer using and saying the accounts money used to be transferred into are not mine will they believe me?

Well, there's no reason not to apply and see what they say.

You can tell them the details of who the account holder is and perhaps can get something from the bank to show that the transfers were made by your ex if need be?
