Hi, can you please advise me why a decision maker would disagree with a GP report and an EMP report and refuse DLA at any rate?
My care needs, supervision needs and symptoms, although described in great detail by GP and EMP have been totally disregarded, and I am apparently not at risk of becoming aggressive ( have been in trouble with police for verbal and physical assualts because of my illness) and also cannot go out side because I am petrified of going anywhere on my own, so need supervision, I do not take care of myself and wont get up as I feel life is not worthwhile and need encouragement all the time, I need someone to gove me my medication, because if I have it myself, I would take an overdose, and I have to be supervised taking it, or I would store it up and overdose, and without the medication, my life would be at even more risk, yet I have still been refused? Please help. I find it difficult to deal with normal day to day things, like going out, remembering important things, sleep deprivation and stress and depression without someone who doesnt know me telling me what I can and cant do. I know perfectly well what I cant do, but WANT to do, but as I have my illness, I am stuck in a rutt with no one to help now. Thanks.
(ps, posted similiar post for DLA person to reply to, but they are on holiday, so hoping someone else out there can help)
(PPS, I have also started the appeals process, but I just have so many questions going through my mind and I am becoming more and more agitated with it all)

I think you have your information very wrong. I have not worked since July 2006 because of depression and Disc degeneration in my back. The case of my mum dying is an added stress on top of everything else I already have to deal with, which is why it has been left in the hands of a solicitor!
I think you will find if you read it correctly, you will see that my mind was working overtime, not me. And I certainly aint been out with any friends and nowhere on that page does it say that?0 -
You've probably been turned down as your information did not meet their carfully worded criteria (e.g. not all doctors know the right things to say and can put their foot in it).
What ever you do, Don't handle your appeal alone as you need someone qualified. Give mind or the CAB a call and ask for a benefits advisor to go through everything with you. If you get in touch with the DWP just ask for the reasons to be put in writing, don't be drawn into giving any more info over the phone, say you'll do it in writing and let a benefits advisor take it from there.
Try not to stress about it too much as it will be a slow process which Is why you need professional support.

Thanks, I got CAB to fill out the form, and I will be contacting them again to help me appeal, they have been very helpful so far.
I am expecting a call back from an advisor from DLA sometime soon as they said when I asked for more information, they could not give it there and then, and would call me back within 48 hours. I will keep what you have said in mind. Just curious, and probably a very stupid question, but why is it better to put it in writing than just to give them info over phone?
I am glad there are some helpful people out there that understand my situation who dont make judgements and dont just pick on me because they dont understand, as that is the LAST thing i need right now!!! All I need is helpful advice as to what to do.

Missk249, people with mental health issues are often sidelined (which is why I took the time to answer).
I've been told by a benefits advisor that the new ook form can be particulaly tricky for people with such conditions and that sometimes there is only one question which really covers their problems.
I'm glad you have someone at the CAB to help, the reason I wouldn't deal with them over the phone is that I delt with them over the phone and it was a disaster.
1. you have no written record of what was said and it is down to the operators interpretation plus if they make a mistake you cant prove what was said. (I got a horrible operator who treated me disgustingly, I was so upset I made a mess of the whole thing).
2. you may make things much worse by saying the wrong thing, especally if you get flustered or upset. get objective advice before you tell them anything and get your advisor to write the letter.
What you need amounts to legal advice, you wouldn't represent yourself in court (or you'd be an idiot), this is a legal matter just the same.
Diability law is complex, Things that seem important to you are often not consdered by the DWP, so you need an expert argue your case.
3 any information you are persuded to give over the phone uses up your 1 chance to clarify things before you are forced to go to appeal. if you waste it because you don't know the right thing to say you are forced to go through the full blown appeals process which may take months.
If you let your advisor write with the reasons you may save your self alot of stress.
4. if you have to appeal you may only do so on certain grounds (one of which is that you didn't fully understand the questions, you will need someone to explain things properly to be able to give a fuller answer and create grounds for appeal.
Finally, normal rules apply, photocopy everything you send, and get proof of postage (free from post office).
