Housing Benefit and maintenance

:confused: I am in the middle of a divorce and receiving Housing Benefit for the house i am renting. It only covers two thirds of the rent but with my salary and child tax credits I am able to cover the rest. My question is this...my ex husband has so far paid me no maintenance and my solicitor has advised me to try and reach an amicable agreement with him. However, if he agrees to pay me £x amount per month, I presume I have to declare this as income and will then lose my HB. I am positive that a few months down the line he will say sorry can't pay you this month...what do I do then? If I have to put a new claim in for HB I will be really stuck as it took 4 months to be agreed originally!

Any advice greatly appreciated!!:confused:

    Your solicitor is out of date - since 27 October 2008, all income from child maintenance is disregarded in the calculation of Housing and Council Tax benefit.
