paypal unclaimed payment

HI, can someone please advise, I won an auction ten days ago for a pair of shoes, winning bid £1.00. I paid immediately via paypal and the payment was refused, so I paid again, and the seller hasnt yet claimed the payment, and obviously hasnt sent out the shoes, What do i do now, they are not responding to emails, I dont want to just leave the payment sitting as paid from my credit card as it has already been debited, and is on my current statement. Any advice welcome, thanks Elmer

    Unfortunately there is not a lot you can do whilst the payment is unclaimed, it means there is a problem with the receiving paypal account. It's probably because the seller is trying to sell with only a basic account and so can't take anything other than a direct paypal transfer. However, that is not your fault, it is his for not having set his preferences correctly.

    After 30 days the payment will just bounce back to you if it is still unclaimed, but before that date th eonly way to get it back is for the seller to reject the payment.

    However, you can make things difficult for the seller which might prompt a reaction and response to your emails. Start a non selling seller complaint today here's the explanation:

    Basically the seller is in breach by not accepting your payment and the penalties are as follows:

    Breaches of this policy may result in a range of actions, including:

    Listing cancellation

    Limits on account privileges

    Account suspension

    Forfeit of eBay fees on cancelled listings

    Loss of PowerSeller status

    Alternatively get the sellers telephone number and give him a call, although persoanlly I would go for the NSS complaint as that will get his attemtion soon enough.

    Elmer, exactly the same happened to me and it was not until I reported the seller to ebay (with advice from Soolin) that he responded.
    Seller has now sent me an email apologising for delay sending goods - no explanation given and as yet still not received goods.
    I also contacted paypal but they said they could do nothing and would refund the money to my paypal account after 30 days if it was not claimed.
