goods ordered not as described

daughter ordered last Tuesday and paid same time.dvd boxset was 'sent' on wednesday first class post and daughter paid extra for insurance.when nowt had turned up i emailed the seller twice and the last correspondance was yesterday.dvd's strangely turned up this morning-after i'd asked for proof of postage which i didn't get.now the thing is they were described as new but there was no seal and there is what my daughter can only describe as condensation on the discs. she's really annoyed not just for the fact that the seller was giving us the run around but that the dvd's have been used.i wasn't with her when she placed an order ( she just looked at the overall feedback) but subsequently i read the negs and it appears that lots of people have complained cos they received used copies/didn't receive owt at all/pirated copies of games.as one person said he was a conman and i believe it.this is the first time my daughter has had a problem on ebay and she's a lot wiser but my question is what can she do about this purchase?

Not all box sets come "sealed" as such. The "condensation" could be just that. Cold parcel sat in back of posties van then brought into a nice warm house.
But without seeing it would be hard to say if they were copies etc, though what you descibe in the sellers actions looks a bit dodgy.0 -

I agee, also RM can be slow sometimes. Just because its meant to arrive the next day, doesnt always mean that it does0 -
Ive just ordered a box set off play.com for my partner for Xmas and it didn't come sealed...i thought it would. But obviously its new.Not sure about condensation tho...as the other said cold van....warm house could do that.

First class post gets delayed, it happens. I'm no DVD expert but going on what has been posted there doesn't seem anything unduly wrong. If they work no issue.0

having no seal is unlikely to be significant.

RM/seal aside what i was trying to say was that the dvd's aren't new-it's easy to tell why cos the plastic on one of the cases is ripped and the box iteself has scratches on it.i contacted the seller and all he said was 'if it is damaged you can return it if you want'.not in a position to view dvd's yet one assumes that they play ok,my daughter wants them and would incure postal charges if she was to send them back anyway-but she paid for summat that said 'new'0
