Topshop Store Card - GE Capital

I signed up for a Topshop store card 6 years ago when I was just 18. I was captured with the 20% discount on your first purchase.
The credit limit was £150 I think at first, over the last 6 years it has been automatically increased to £800 (and I know that I didn't have to spend it) and although I have paid on average £20 per month over the last 5 years I still owe £850.84 because I have missed a couple of payments it has been sold to CL Finance who have now applied to for a County Court Judgment. So with solicitors fees the total is now £975.84. I called them today and said that if I could clear the debt off in 3 months then there would be no CCJ etc. I said that there was no way this debt could be cleared in 3 months and if I was capable of paying that much this debt would have been settled a long time ago.

I have worked out that over the last 5 years I have paid back around £1,200 so this more than covers the actual debt and a chunk of interest.

I know wish to admit part of the outstanding debt to the court and dispute some of it because of how much I have paid so far.

Does anyone have any experience of this? Do judges take any of this into consideration?

Any advice would be most gratefully received.

    What are you actually disputing? Do they have the amount of the debt wrong? Do you have charges that have been added to the amount?

    You can ask for the debt to be passed back to GE Capital if the amount is under disute. This should prevent further action being taken.

    first off its a store card high intrest

    over six years and you have always been at limit paying the min payment you will never clear so i dont see what you are claming for?
    If you dont like me remember its mind over matter, I dont mind and you dont matter ;)
  • Basically I want them to halve the amount owed based on the fact that it is only interest that is owed. Is this unrealistic? They have offered me the chance to pay over 3 months but this is over £300 a month which I cannot afford.
    I am heading towards a CCJ which I really don't want - especially when I have cleared off all my debts but this and my car debt. Just when I am starting to get back on track and now a CCJ?

    Does anyone have any experience of this? Are judges sympathetic?
  • you could maybe ask them to freeze their interest to help you repay it but unfortunatly i dont think your arguement that you've paid it back already with interest will stick.

    arcadia (i.e topman/topshop/miss selfridges) cards have a very bad rep i've heard. arcadia staff HAVE to have 1 when they turn 18 to claim staff discount. they may have stopped this practise now but they basically encourage staff to take on debt. devil cards from my friends experiences!

    Send CL Finance a detailed outline of your budget showing how much you can afford to repay and ask them to freeze interest. I owe them about £800 and did this and they have agreed at £5 a month for the time being and no interest is being added. This offer of repayment will also go in your favour if it comes to court. Also, whilst doing this, start a claim with GE Money to reclaim any overlimit/unpaid charges.

  • This is already going to court and CL Finance will not accept any offer lower than about £300 a month. I only have another 5 days to fill the court form and send it off.
    In a real muddle - which I know is my own fault.
    Need some help!
  • Well actually CL Finance are no longer dealing with it. They have passed to another company and I am now in contact with their solicitor who has stated that I can pay off but only payment options are 4 months max.

    if it went to court you would have much longer to pay it off but costs would go up, tell them that you can only afford x amount. The county court would most likely set a lower amount.

    u defaulted... didnt pay back when they asked so now u in the doo doo...

    cant blame GE here... they sent u a letter saying 'there are default sums...'

    i dont think they will be nice to u since they had to sell the debt on... you clearly 'ignored' the problem...
