Will brother in law affect benefits

Hi all
Newbie here
Question is will brother in law affect our benefits.
We are to move house soon . And in order to afford the house we want in a good area we have all decided that it would be a good idea to all move in together. My problem is that i am not exactly sure on the definition of a non dependant with regards to HB. His name will be on the tenancy and he will be liable for a third of the rent. This he will transfer to my account so that all the direct debits come out of one account.Has any one any ideas
Thanks in advance

his income will definately be taken into account if he is paying part of the rent0

I thought the same until i saw this on entitledto website
A non-dependant is a person who:- resides with the claimant, and
- is over 18, and
- is not a partner, or dependant child of the claimant and/or their partner, and
- is not liable for paying the rent or pays rent to you as a sub-tenant.

if he is on the tenancy he is not a sub tenant though i donbt think0

They and you are not classed as each others non-dependants.0

just had a look at the local councils benefit estimator
I think this should answer my question
Step 12 - Looks for other adults who live with you and pay no rent (often grown-up children) - but don't count your partner or students
As my brother in law will pay rent i believe his income is not taken into account as he is a joint tenant
Can anyone confirm this befor i ring the council in the morning0 -
i find it hard to believe that his earnings would not be taken into account but don't know-just seems too good to be true to me!Tomorrow is always fresh, with no mistakes in it!0

would seem abit odd,as a grown up off spring would count as an adult and their earnings taken into account,I suspect the same would apply to your BIL0 -
Can't understand why you're talking about "affording" rent when you're not paying it anyway. Surely you just need to rent somewhere that will be covered by LHA?0

we are currently in a housing association property and get £25 per week towards rent. the area isnt the best area and the house is quite small. Family of 5 (2 adults 3 children). We wanted to move to better area and have a larger house.0
