Help, shop has lost my bracelet

Not sure if I've posted in the right area but here goes.

November last year money was extremely tight, so just to get a bit of ready cash I kind of pawned a gold bracelet. Every month since then I have paid £20 to extend the 'buy back agreement'. Thats £20 each month.

So last friday as I had a very good month at work I decided to buy my bracelet back, their full asking price of £100. To my amazement.....they have lost it!!!

Now they say that they have put it into 'storage' as it was out of date (the last time I extended it was the 8th October 2008). So since Friday I have been calling them and all they are saying is that they are trying to look for it!

Do I have a leg to stand on if I decide to take this to small claims court?

Any advice appreciated. Thanks.

    Doing voluntary work overseas for as long as it takes .......

  • They should at least refund all those £20s that you've paid. For all you know they could have sold the bracelet straight away.

    In effect the buy back agreement has been broken because they do not have the bracelet. So you've been paying your money for nothing. Hopefully this is how the small claims court will see it.

    First of all send them a letter asking for the bracelet to be found within 7 working days. If those days pass without a peep send them a letter to refund the £20s you've paid within 7 days.

    No response, then I'd file with small claims court.

    Did you get receipts for the £20 each month that you've been paying?

    Send them a letter, recorded delivery, telling them that you'll be calling into the shop on <insert date in a few days time>, and if your bracelet is not there to be bought back, then you'll be taking them to the small claims court for the cost of the bracelet, along with however much you paid to hold it. Make sure they don't try and sell you a replica...

    Personally, I think it crazy to use a pawn shop, as if you're that strapped for cash, then any items of value should be sold privately to generate as much money as possible.

    And how exactly are you supposed to get them back when things improve? :confused:
    If you lend someone a tenner and never see them again, it was probably worth it.

    If they cannot find it regardless I would take them to court for the full amount. Not sure if this is within your rights but they should not profit from this IMHO
