income support overpayment 11 years ago

Hi

Hopefully someone here can help me out with this....

was overpaid IS 11 years ago.....recently applied for IS again after working and have just received letter stating amount to be deducted from benefit for overpayment..

Is there a time limit on how long they can chase you for this?

    Did you know at the time you had been overpaid?Could it have been their fault i.e. official error?Personally I`d be very tempted to ask them to prove it,unless of course we are only talking about a small amount?

    No the 6 year limit does not apply to these types of debts.

    but how, when IS is supposed to be the absolute minimum the government says you need to "survive" on, can you be expected to repay anything from it :confused:

    I'm sure that some people don't have any choice about the deductions being made, whether it's for utility bills, council tax, fines, social fund, or in this case an overpayment. A condition of getting a social fund loan is that there's an 'income' to recover it from - including IS payments.

    I believe the 6 year limit DOES apply to debts to the Social Fund and Benefit Overpayments.

    However, the 6 year limit merely means that they can't take you to court over the debt.

    They CAN (and will) deduct it from further benefit payments after this time, which is perfectly legal. They just can't take you to a civil court.
