I see that it's getting the usual definitive replies that you usually get on pepicrap. :rotfl:

I take it you're unaware that they often can't agree on anything and by the time they do come to a consensus, your deadline has well and truly passed?

Well, they renewed the 14 days when they gave the rejection so I've got a few days left.

However, I am going to fight this one. I can't afford to do anything this Xmas, so I may as well make some council official miserable and set right a wrong.

Traffic Signs Regulations and General Directions 2002:
    http://www.opsi.gov.uk/si/si2002/20023113.htm

    Some of what applies.
    • "controlled parking zone" means either -
    (a) an area -
    • (i) in which, except where parking places have been provided, every road has been marked with one or more of the road markings shown in diagrams 1017, 1018.1, 1019 and 1020.1; and

(ii) into which each entrance for vehicular traffic has been indicated by the sign shown in diagram 663 or 663.1; or
    (b) an area -

    (i) in which at least one of the signs shown in diagram 640.2A has been placed on each side of every road; and

    (ii) into which each entrance for vehicular traffic has been indicated by the sign shown in diagram 665;

Conner, just so that I know where I stand, given the information you have provided above alongside the information I have provided in this thread and the pepi thread, you say that I have no defence.

As far as I can see, because LCC have put up boundary signs that have the word Controlled Zone, this is more of a 663 sign than a 665 sign and therefore falls under category a) right?
    http://www.opsi.gov.uk/si/si2002/02311359.gif

Therefore, are you saying that thereafter, that signs 661.4 and 662 etc don't really matter?

Also, the above states 'except where parking spaces have been provided'. Now I am in a parking space provided which has its own restrictions. Therefore, has a single yellow line not existed in that parking space, what is the effect of the controlled parking zone sign? If it would have no effect because its a provided parking space, why would any additional effect be in place because it has a single yellow line unless additional restrictions are placed at the parking bay itself? Or are you saying that without the single yellow line, they could do you also?

    Thanx

    Hi,

I sent a representation in response to an NTO on 27/11/2008.

I have not had an official response from Leicester City Council rejecting the representation.

However, on 02/04/2009, another NTO was sent out (the only difference being that this one does not include the 50% early bird discount).

This is now going back quite a few months.

Both NTOs have this stated on it:
"If your representations are received in time or are received late but taken into account, Leicester City Council will let you know its decision in writing not later than the last day of the period of 56 days beginning with the date on which your representation was served on it. If it fails to do this, this Notice will be cancelled and any sums already paid will be refunded. If your representations are rejected, you have the right to appeal to an independent Adjudicator. An appeal form will be sent with the letter rejecting your representations. The form will explain how and when to appeal to the adjudicator."

Does the above clause mean that because LCC have taken a long time to get back to me (they still haven't rejected my representation - just sent a second NTO 5 months later) that I can take this to mean that the NTO is cancelled?

    Thanx
