Golf Lessons Refund

Hi,

I'm looking for some advice regarding getting my money back for some golf lessons that my fiancee got me last Christmas. She spent £57.50 on a '6 for the price of 5' lesson voucher, however when I came to book these in august there were 'legal' problems with the instructor which sufficed to say after 7 weeks of trying to arrange them and 3 cancelled lessons (2 of which I turned up at the golf place to find the instructor had gone home) I gave up hope of getting the lessons (not that I'd want them now!) and decided to get my money back.

The money was paid to the golf centre by my fiancee, however they seem to think it is the instructors job to refund me. I have told them (verbally and in writing) I will pursue them for the money as it was paid to them, and wrote a letter advising I would give them 14 days to pay and after that begin legal proceedings. This was 3 weeks ago, and although the golf centre have refunded £7.50, they are insisting the instructor pays the remaining money himself (£50). He has said he would do this however constantly breaks his promises so I am looking to being the next legal steps to recover the money.

It's my understanding that I need to write a 'Letter Before Action' however I'm not quite sure what to write so I was wondering if one of you nice people could give me some advice or point me in the direction of where I could get some material to help with this?

The other thing I am unsure about is that if my fiancee actually paid for the lessons and gave them to me as a gift, can I pursue the refund or does my fiancee have to do this herself as she bought the lessons?

    I would write something along the lines of:

    Dear <insert name>

    Following on from my previous letter dated <insert date>, I wish to point out that the money was paid to the golf club, thus our contract is with you, and NOT with the individual instructor.

    Many thanks for the £7.50 paid. We expect to receive the remainder of the money owed (£50) in 7 working days, and if this money has not been received by <insert date>, we will have no other option but to start legal proceedings.

    We appreciate you may have already paid <name of golfer>, but as our contract is with you, then you must refund us the money. Perhaps you should be persuing <name of golfer> in a similar manner to recover your funds?
