    Even if the OR disallows it on your SoA you can still keep them and pay out of any surplus you may have?

    how much of the surplus would they take say I had £120 surplus not sure what to put down for my wages these are made up of basic, bonus and com but have dropped over the last 3 months frorm £1600 to about £1400 for this month plus overtime could finish at any time and do they take child benefit into account for the I&E

    With £120 surplus I think it's 50% so they'll take £60, however if, like you say, your income has come down then this needs to be shown which could reduce your surplus below the £99 threshold :)

    I'm pretty sure CB isn't taken but someone with kids can confirm this?
