Got my BR date

Well I have just rung my local court and spoke to a lovely lady, said I did not know how to do it but needed to book a date to declare myself bankrupt, forms are on the way and the date is December 5th at 10am.:eek:

Told my husband who has been fantastic, he had no idea what mess I had got myself in. Its times like this when you realise how good a marriage you have. If there is anyone in my situation, speak to you partner. I got into more debt so everything looked normal.

I thank everyone who has put postings on either as questions or support.:A

Sarah from CCCS sent me a PM and gave me their bankruptcy helpline number, so I am going to contact them when I get my forms and ask for their help to fill them in. Its a very lonely place to be when you are in debt from now on I ask advice and start listening, especially to my husband.

I am going to go and have a cup of tea and realise that 2009 will start better than 2008.

    Hi me and my partner both had to go BR I looked after all the finances but eventually it all got too much and I nearly ended up in a mental facility.I came clean and told her our financial predicament and got advice from people about going BR.Ifilled in all of the forms and we have both been BR for nearly 2 weeks now, we are getting a bit of greif but its not as bad as I thought we moved out into a rented property and sent the keys to our house yesterday surrendering it to mortgage company.Court lasts about 5 mins when you get in judge asks 2 questions whether you have take professional advice and who from what did they suggest and do you understand the implications of going BR.He then stamps forms and says you are BR as of now and they really are very nice ppl not at all judgemental of you don't worry plenty of people are all in the same boat everything will go fine.

    Post man has just been, dreaded if there were any letters from creditors, I sent them a holding letter from CAB last weekend and expext demanding letters. There were none but there was my CO-OP card, that was quick only rang them last Saturday.

    Starting to organise priority bills to come out of my husbands account.

    There is going to many questions. First one that springs to mind is that two years ago I was a self employed secretary, I received an unexpected tax bill of 1200.00 pounds, I paid 400.00 off it then set an arrangement up with the tax office of £20 a month on Direct Debit, what do I do. I am on the arrangement and have 700.00 left to pay. Does this get included in my creditors?

    No sure about the tax question but just wanted to say,you don't always see the judge,i didn't:D and it was such a relief.D

    As far as I have been made aware tax cannot be included in the BR and you would still be liable for it after being discharged.Also things like fines and child maintenance cannot be included either.

    I took out a loan prior to going BR as I had a council tax bill to pay (before we found we had to go BR) and the loan was included in our BR.

    I finaly got round to phoning the court and my dates 12th Devember at 11:30. The way I'm looking at it is that my christmas present next year will be my discharge.

    Thats a great way to look at it, two christmas presents sorted then 2008 and 2009!

    I did see the judge and he asked a lot more than you have mentioned he was in fact very nice and very chatty that morning, in fact I am sure we could have chatted a lot longer!:D I thought he was lovely!:T
