Warranty

Hello there,

I was wondering if there is any experts out there who can help me in my predicament.

We recently had a problem with our washing machine, where the drum stopped spinning, and as the washing machine belongs to the landlord, we reported it to him and he immediately informed INDESIT the company who manufactured the machine. At this point, we were never told by either INDESIT nor our landlord that the warranty had expired on the machine.

To cut a long story short, a sock had somehow managed to get the drum to be stuck, and without INDESIT informing us the warranty had expired they sent a engineer out to fix it. He fixed the machine, but left the waste pipe out which damaged my kitchen unit and flooded my kitchen. It took 3 attempts from INDESIT to sort this mess out (including cleaning carpets in my hallway).

Now INDESIT want us to pay a bill of £90 as the warranty is not valid, which obviusly due to their incompetence, and my time wasted, I am not happy about paying. I have informed them of this, but now they have got their solicitors involved. Rather than waste any more of my time I thought I would just pay it, but then the prinicipal of the matter is why should I pay for this chaos they have caused, and at no point did they tell me the warranty is invalid until the job was completed, otherwise I would have just got out our local plumber who would have done the job for half the money and properly!

Does anyone know where I stand legally on this, as I will need to respond to their solicitors.

    1. the repair contract is between the landlord and indesit, not you.
    2. knowing the warranty period end, is down to the owner, not indesit.
    did the landlord make it clear that it was a warranty issue? or did he just ask for an engineer to repair the machine? he should have asked for a quote.
    3. it might be an idea to send them the amount, you think is the price a local would have charged. say 50 quid.
    4. i would tell them, i will see them in court for the balance? they may then decide to leave it at that.
