Help Needed About Bailiffs

hI everyone, i dont know if i am in the right place, i apologise if im not, but i really need some help on behalf of my son. He forgot to pay a parking fine , unintentionally, as he has been off sick from work for 4 months and just forgot about it, and yesterday he had a letter hand delivered pushed through door from Jacobs certified bailiffs saying if he doesnt contact them within 24 hours they will come and seize his goods to pay for the debt. My son phoned them today to ask if he could pay off the debt bit by bit as he was only getting statutory sick pay and couldnt afford the whole amount at once, which is £270 (which started off as a £30 parking fine!!).and they told him that if the full amount is not paid by this friday then they will come and seize his goodsto pay for the debt, what I want to know is can they do this and does my son have any rights at all. thanks in advance

For a start, can you have a look at the web-site in a moment, then Pm Herbie21. if you do not get an pretty immediate response (she has not been on here as frequently this last week or so), then phone the number on the web-site.
She needs to know the following
What is the amount of the debt and for what?
Which firm of bailiffs?
Are you on benefits?
Can you send her the name of the bailiff who signed the notice so that she can check to ensure that he is certificated.

When I first read this post I also thought that this was to do with an outstanding Magistrates Court Fine. It was only when reading that it was Jacobs bailiffs that I realised that I was wrong.
This is an unpaid parking ticket so the Statutory Declaration that is posted here is of no use. It can only be used for an unpaid Magistrates Court Fine.
There are only three grounds on which your son can file an Out of Time Declaration and they are that:
He did not receive the PCN or Notice to Owner.
He made an appeal but did not receive a response
He appeal to the adjudicator but did not receive a response.
As you have stated here, he did receive the PCN but did not pay it due to his illness.
The bailiff cannot break into the home, but he will almost certainly clamp a car owned by your son. Does you son have a car in his name? This is important.
Secondly, as the bailiff has only ever visited just to post a letter through the door then the charge should be minimal and you need to question how the bailiff co is charging fees almost 10 times the cost of the PCN !!
I would also request the name of the bailiff who "apparently attended" at your home. This is important. Once you have the name can you please send a PM to me so that I can search our datatbase to ensure that he is certificated.0 -

thanks RAS and Herbie for your info. in answer to your question herbie, yes my son does have a car registered in his name.I will send you a PM with bailiffs name. the letter he pushed thro door has a photocopied signature with his mobile phone number which my son phoned to offer to pay by installments and of course they now have his mobile number and they have been texting him and phoning all day today, the last text he received said " you have 2 hours left to pay then we will come and take your goods" surely this is harrassment? Im so glad you said that they cant break in as im sat here with all doors and windows locked and the light off! thanks so much for your support both of you its much appreciated.0

Your son needs to make sure that the car is kept well away from the house, or they will come and put a |Walking Possesion order on it. Even worse, they may well clamp it and refuise to remove the clamp until he pays them money and possible post-dated cheques.
