Desperate Help Needed please....Bailiffs

Not sure this is the right place to put this but I dont know where else to put it.

I got a parking fine in 2005 for parking where I shouldnt have been which was fair enough I also went through a red traffic light round about the same time reason being my husband walked out after 26 years and was a dame shock and i drove to my mums.
Anyway I thought this had been paid But my mistake I paid the red light one and mistook it for parking fine.
I had letter after letter from the council concerned And I sent them a copy of the check which I paid the trafic light fine which they say they never received. So I never heard anything for 18months so thought it was paid.
On the 24th october last Friday I went to take my daughter to school to find my car had been clamped by Bailiifs, who put a sticker on my windscreen to alert me this had on it if I didnt pay by 10am my car would be towed away this was parked on my drive.
I got the notice at 8.am and they started kncoking at my door from 8.30 harrassing me and demanding money, Can I just add here I never knew who these people were they wouldnt show id or any paperwork concerned with this so at the time I did not know what it was for Only the amount of money they demanded which was 489.94.
I asked to see paperwork and I was told that i had to call their office so I did and was told i had to write in for this........... Bloody hell how was I supposed to get proof if I had to write in and they were taking my car at 10 am.

All this is very sus anyway I paid 100 on my debit card and which they took 101.00 and was not told of any charges for this, and issued checks for the remaining amount as who can you ask for 500 at that time in the morning.

Well I have since cancelled the checks and wrote to them direct asking what the hell they were playing at with no Id and nno paperwork shown to me.

The council only passed this on to this company on the 1st sept 08 and they advised me that I was supposed to have one letter and one visit before all of what happened on fiday took place.

I am desperate regarding advise here I have paid the fine now to these people for the council concerned But have cancelled all other moneys for fees as If they had sent tme a letter this would have been delt with, And I know they never came to my house as by law they are supposed to leave a card to say who they are and why they visisted.


The car is still on HP and is in my husbands name not mine although the car is registered to myself, We have now changed the log book well its in process with DVLA back to my husbands name and the debt is in my name only.

What can I do ??????
I dont believe the girl with this young man was a bailiff I beleive she was his girlfriend out with him and she gave me so much bloody lip I wanted to knock her out.


Someone please can you advise me

    If this was a parking fine, they should not have attempted to clamp your car until they had a Walking Possesion order and given you the opportunity to make arrangments to pay.

    And if the car is on HP, they are not legally entitled to put a walking possession order on it either.

    In the very short-term, it is likely that you have signed a WPO, which means they have the right to remove the car anytime. So make sure you get it well away form the house.

    Rugith now, get hold of the HP documents, photocopy them tomorrow and send them registered past to the Bailiffs office.

    If any of your local councillors (assuming this is your own area?) have a surgery tomoorow, go and see them and try to get the parking fine taken back by the council. They do have a duty to take responsibility for how their debts are collected and it appears that since they are allowed to use unceritifiated bailifs for this sort of collection, they have selected a right dshark.

    I never signed a walking order I have had one of those and as long as you dont sign they cant do anything.
    But i wasnt even contacted by this company at all before they did all this and they should have contacted me giveing me the chance to pay.

    Thank you for your help But they took the 95.00 off my debit card for the fine and so I have written to the council asking them to put a stop on this now its been paid.
    I am not paying the fees and I am most positive that the girl with him wasnt a bailiif she was his gorlfriend he had no jacket on just a shirt she had the jacket on it s all very sus to me

    I have written to both parties stating how I was treated and to be quite honest if it had been an old person they could have died of fright they did not stop hassleing me for 2 hours and I was given till 10 But they kept knocking and saying the tow truck was on its way and if It came i would be charged another 175.00 on top of the 489

    No Nothing at all because I wasn't given anything nor did they send anything to me at all

    But please be aware that now you have stopped the cheques, there is every chance that they will come back and clamp the car again.

    Please read the web-site that cat posted and pm Herbie 21 who runs it.

    I would strongly suggest keeping the car somewhere else until you have this sorted.

    Herbie's a regular on here who knows all there is to know about bailiff law. She runs a site about it, which someone gave you the link to. She's really great at what she does!

    Herbie21 runs the most effective bailiff fighting organisation we know of. She comes on here quite regularly and helps people to sort out bailiffs who have broken the rules, demanded unfair charges and bevaed badly in other ways.
