Speak to your landlord and negotiate. At the end of the day you may have to face the increase or consider moving.
Thanks. Yes you're right, we want to negotiate. We do expect an increase and are happy to pay a bit extra but want to suggest that such a large increase is too expensive in one increment, especially given the lack of notice.0 -
Ok so here is the response from the landlords office, please ignore the poor English, as I mentioned in an earlier post they are often difficult to deal with and this is one of many reasons:
I did have a word with my Director.
All the flats in Stockwell Rd that we have - cost £1250pcm. We will be increasing even those rents once expired.
You lived there for such a long time without any increases.
Landlord doesn’t accept your offer of £1191.30pcm.
She wants £1250, because this is a market rent and she is getting from all Stockwell Rd properties this amount.
Please let me know, if you prepared to stay for £1250pcm, otherwise if you decide to move out, you need to provide at least 2 months notice.

I thought that if you are on a periodic tenancy you only have to give one months notice.
Correct me if I'm wrong.
My rent goes up from 1st December from £295 to £305, and I received a section 13 notice back in September. It's a fair increase so it doesn't worry me, but it sounds like your LL is trying to see what they can get away with.
At least insist on a section 13 notice.0 -
and yes we are now on a periodic tenancy so yes I think we do only need to give them one month's notice if we decide to move out. However, if they wish to evict/terminate the tenancy I think they have to give us two months notice don't they?
We have these sorts of issues with them all the time because they are foreign and used to different property laws abroad. They do not like it all when I point out the proper way we should go about things

Rigsby's cat - you've clearly got a LL/LA who's not prepared to play ball.
If you pay your rent monthly & on are on a periodic contract you only have to give them *one* month's notice, running from a rent day. Your next opportunity would be to give notice by the 4th December to leave by the 4th January.
Now that the LL/LA has refused to meet you halfway, they *have* to give you formal notification of the rent increase and then you have the option of challenging it as I mentioned above. If you just pay it then you will be deemed to have accepted the increase.
So you're on a periodic tenancy, rent is paid monthly and due on the 4th?
Your LL has to give you at least one full month’s notice of the increase, so the earliest he could now increase the rent is on 4th December. He must notify you in writing via a Housing Act 1988 S13 Notice, and the notice should advise you of your right to challenge the amount of the proposed new rent via a rent assessment committee (bear in mind that you have to lodge this before a new rent becomes due)................................
Have you been served with a S21 Notice at any point during your tenancy?
If you need clarification on correct notice periods contact Shelter, a local CAB or the Council's private sector rentals team
Have you been given the formal S13 notice yet? If they haven't done it by today , your rent day, then they can't now increase it until 4th Jan. The Private Sector Rentals Officer at the local Council (they deal only with private lets) or a LL & T worker at the local CAB can give you information on how to proceed with all of this and but you obviously have to account for the fact that they may just be daft enough to lose a reliable tenant and seek repossession of the property after you have challenged the rent. (However, they have to abide with the RAC’s decision on the rental which may not be the figure they want, and that’s the case whether they ask you to go or are still okay with you staying on ) And yes, they have to give you 2 month's notice to tie in with your rent days if they want you to go.

No we have never received the formal S13, all I got was a telephone call on 28/10/08 telling me this is what they are going to do as of 4th November.
Like you say the earliest they can enforce the change would be 4th December, which is fine. We will not waste our time arguing with them or getting other parties involved and will most likely hand in our notice and look for a place of the same price or cheaper. We could do with saving a bit more for our own deposit anyway. But will miss this place, after 3 years its a shame that the landlord won't be more reasonable.0
