Faulty TV 'allegedly' JUST out of warranty - HELP!!!

Hi there,
Just a bit of advice needed please folks.
I bought a Bush 14" TV/DVD combi last October for my daughter as a Christmas pressie. 4 times since having it, it has developed a selection of bizarre faults, ranging from loss of sound to the latest one - a grinding noise when a DVD is playing.
On these past occasions I managed to get the problem rectified over the phone with the Bush helpline, (by setting the TV back to factory default settings
) but this time they couldn't sort it and advised me to contact Marshall Ward where I bought it from.
This is where the issue begins. Marshall Ward tell me that the TV is now out of Guarantee because I ORDERED it on 11th October 2007. However, the TV didn't arrive until the beginning of November and then wasn't used until at least the day after Boxing Day. So in my opinion it is still under warranty. I understand that it isn't their problem if the item wasn't used until after Christmas, but taking the year to be from the date of order is somewhat unfair I feel. Surely (as the item had to be signed for) they have proof of the delivery date to my house and should take it from that date?
I explained this on the phone and the 'advisor' just came out with the usual blurb about 'did you take out the extended warranty at £30 extra?' etc.
Now, I hope most of you agree that Mr Lewis nearly always advises us against buying these things because they are just a money making scam, and realistically, you expect a TV/DVD to last longer than a year!
Even if I did agree with these warranty rip-offs, then having to pay an extra £30 for a warranty on the cheapest TV/DVD combi I could afford wasn't an option either. Trying to find the £80 it cost was bad enough, without an extra £30 on top. (And no, I don't smoke, eat takeaways or drink heavily - before the lynch mob get me about affording it! I'm just in a cr4p job and bl00dy skint like a lot of us!

The TV works fine and DVD's are still playable, but it just makes this horrible grinding noise continually, regardless of type of DVD/CD etc.
Thoughts please? Am I in the right or wrong here?

The fact that you didn't use it is not relevant. However if it wasn't delivered until the beginning of November then the date you signed as accepting the TV is the relevant date in this instance.
I would suggest getting back on to Marshall Ward and speaking to a supervisor if you get no satisfaction from the advisor.

Yep - I quite agree with that comment and fully understand my rights with that part of it, but as you say - the date of ACCEPTING the TV in my house should apply.

Yeah - too true!!! The bl00dy washer broke down last year - exactly ONE day after the 12 months was up!!! :rotfl:!!! How unlucky am I?!
Fortunately, after a nice letter to Comet, they used a bit of 'goodwill gesturing' and sorted it - although the flippin fuse went on it today and I thought it had broke again!!! lol!
So, an equally nice letter to MW is prob the next best option.....0 -

could you still not make a claim for repair stating that it is reasonable for a TV to last more than 12mths before breaking (is it covered under sales of goods act????), have a search on here as there have been many companies that have repaired/replaced items outside of warranty when issued with small claims court action0

I think that you will find, by a little digging in the consumer rights dept, the 12 months guarantee, is one given by the manufacturer. It counts for very little. It is wether or not the item is of merchantable quality and could be reasonably expected, to last longer than 12 months. e.g. It would be reasonably expected, for a washing machine to last longer than 12 months and therefore if it breaks down after that, you take it back. That is what the buisness about `Statatory Rights` means. They are unaffected by any guarantee you may be given. Your `Statory Rights, are that you can return items after 12 months if, you can reasonably expect the item to last longer.
That sort of disclosure, does not help the retailer, who`s main interest, is to take your money off you. I hope that makes sense, but you would have to look it up to fine tune it.0 -
sounds like the eye of the dvd needs cleaning go into a pound shop and get a DVD cleaner, my phillips tv does grind, clean it and it solves it.0
