Bailiffs

Our son (27) has some outstanding debts, is not working and has not been home for several weeks.
We received a letter through the door from bailiffs saying that a debt has now been passed to them. I phoned them up and they said that they would give us a week to pay the money. If we don't pay they will be round to collect our belongings. I explained that our son does not own anything here worth taking and I was told that they would take our belongings unless we could prove that they were not his (ie we must have receipts). I was also told that they would bring along a locksmith and enter the premises whether we are there or not.
They very kindly agreed that they would let us know when they would be turning up so that we could arrange time of work!
Can anyone tell me whether they are entitled to break in and take our belongings?

Unless they have a very specific type of court order, they can only acces the house with your consent and they are not allowed to remove your goods.
For a start, can you have a look at the web-site in a moment, then Pm Herbie21. if you do not get an pretty immediate response (she has not been on here as frequently this last week or so), then phone the number on the web-site.
She needs to know the following
What is the amount of the debt and for what?
Which firm of bailiffs?
Are you on benefits?
Can you send her the name of the bailiff who signed the removal notice so that she can check to ensure that he is certificated.

If it is for a fine etc then you need this which you can sign to prevent the bailiff taking your property to pay your son's debt.
Nicked this information from a previous post by herbie21. it need to be witnessed and there is a small charge, herbie suggests elsewhere that £5 is normal.
Regarding the Statutory Declaration. The following is a simple Stat Dec that would need to be signed by the person who owns the goods listed on the walking possession.
This can also be adapted by anyone who owns goods to ensure that they are protected from seizure by a bailiff company.STATUTORY DECLARATION

They are trying to get you to pay your sons debt by basically lying to you... Please don't let them bully you! They have NO rights to ANY of your belongings and you do NOT have to let them in!

I have written to both the bailiff and the court (both magristrates and county court because I don't know which the original fine came out of) detailing what the bailiff said to me over the phone and explaining that we do not know where are son is and that he does not own anything substantial in our property (just a bit of clothing and a mattress).
I will let you know what happens.0
