I have already filled in GL24 and had reconsideration and appealed, I am now just awaiting an oral tribunal date. I have a meeting with CAB this week, to help me with my appeal/tribunal. I would have been happy with any award as this is my first application, and was naively surprised when it was a blatent NO.
I have read some explanations on previous posts, ie use stool to stand in kitchen ha ha Stools are really comfy when you have severe pain in your back and down your legs NOT
You probably know the format of refusal. I almost feel that they bring people to tribunal to see if they look half decent and honest and then make the decision, as some claim forms are very informative. Am I a little tiny bit right?0 -
I would suggest simply letting them know of your additional needs now (which replaces the need for the renewal) and once you have had the operation (plus recovery time), let them know of the change in circumstances.
At least that way, you will be getting the additional money for the help you need now, and will still have the operation taken into account once it actually affects you.

Not even a teeny tiny bit
The appeal Tribunals are independent from us, and we get shouted at for lousey appeal overturn rates (50%+) by Ministers, so the last thing we want is a case to go to appeal.0 -

I cant promise you it wont, but if your needs havent lessened since your last claim, there is no reason to think it would be taken from you. (we need VERY strong grounds to take someones existing award from them on supersession where they are claiming increased needs)0 -

Definitely not, probably worse as I had my original award when I was 18, I'm now 21 so it's worse not being able to be left alone and cook, carry anything etc.

Thank you for offering your time and knowledge to this forum.
I would like to ask your advice and opinion.
My sister received higher rate mobility middle rate care, and this was suspended several months ago.
When she moved house in April 2007, we sent a letter to the DLA office in Warbreck Hill to notify them. This year her renewal forms were sent to her old address and returned, and the claim suspended.
Part of her condition is memory loss / brain fog, and she has no comprehension of time, and it was only when I was trying to sort out her money problems, that it came to light about her DLA, now the renewal date has passed, this was early September.
I have written a covering letter to DLA, asking for them to consider the claim as a continuation, rather than a new claim, and sent a copy of the change of address letter,
What are the chances of this happening?

Sadly slim - Late renewals are not normally considered when we are talking in terms of months. Your only real hope is to get her GP to write and support the fact her memory (e.g part of her condition) played a part in the lateness.
Even with this letter, if a DM goes by the book, I doubt it will be accepted. Never say never though - its always worth a try!0 -
