Relationships between my landlord and I are very strained.
Basically I live in the house that jack built. I have damp, went with out working taps in my bathroom for months and also in the past have had dodgy electrics which took hom some tome to fix.
The final straw came when he didn't repair a broken window for a week ( in fairness we broke the window and he told me NOT to get it repaired even though I offered and believed i should pay) and when he finally sent someone round he just sent them around un arranged, and when the man got to my house and I was out ( in uni) he called me and insist I return home. I was less than pleased and it ended up in a row.
When my landlord came out to look at the broken window I had a tumble dryer in the back of the house ( the damp is in the front) it had only been there for 2 weeks, but when we had the argument about the repairman just turning up, he said I was a bad tennant, I was never happy and by the way, he holds me responsable for the damp prob.
Now I have been in touch with the council about the state of disrepair of my home in 2007 they gave him 28 days to do repairs and to this date he has not done this. A follow up call to the council only resulted in me being told I should consider myslef lucky as some of the houses she had seen were much worse than mine
Now, I am def looking to leave and called the agent who I was led to believe held my deposit, to find out how returning the dep worked. She told me the landlord held it and I wasn't covered by the scheme protecting a deposit becasue i moved into my property 6 days before it became a requirement.
I explained about the damp and she told me the landlord could hold my deposit as he believes my dryer caused the damp.
So basically, what do i do. I do not believe for a second my landlord will return my depost to me, which I need.
How do i go about making sure I get my deposit back, can he unreasonably withhold it and does it appear I have a battle on my hands.
I appreciate if you've gotten to the bottom of this post as it is a rather long one. I could go on for pages about the state of my house.
Can anyone advise about my deposit or offer anything about where i stand.
Many many thanks.

If you belive you have not done anything wrong, and he will not give you your money back, you can serve him with a court order for return of the bond
It looks like i am going to have to do something similar my self...:mad:0 -
Thanks, I did wonder if it would come to that. It's a pain that I have to go through extra hassle.
Hope you get your deposit sorted

cant you hold back the last months rent that you will be in your house ??0

Normal rules, send a "letter before action" recorded delivery giving him 14 days to return the deposit or you'll sue then sue him. (At this point I'm tempted to say to stop paying the rent and force him to evict you.... he'll be without rent for 6 months before he gets you out.... but it's generlly not a good idea plus I don't see why you'de want to stay in the house a minute longer than you have to.)Bankruptcy isn't the worst that can happen to you. The worst that can happen is your forced to live the rest of your life in abject poverty trying to repay the debts.0

I did think about not paying my rent, but to be honest I don't really want to do that. I think I'm just going to have to wing it and take him to court should I need to.
