Sorry but another getting deposit back question - rented

Moved out nearly four weeks ago and not heard a thing from LA or LL. Despite the LA having looked at the house when doing accompanied viewings, another call to assess the current market value and yet another call just before we moved out. At all these visits we were told how clean and well had kept the place compared with many they saw.

Started calling/chasing few days ago but calls not returned so called this morning and so far call not returned. My queries are: -

1) Can I get some hard facts as to when they should return the deposit.

2) Do they not have to call me first to explain how much if anything they intend to deduct for anything.

3) Who has enjoyed the interest as I have have been in the same house for 8 years plus. Can I ask for any of it to be paid.

4) Any indepedent part that can give me phone support - council, Shelter or who.

Your help would be appreciated.

Yes - but WRITE. Don't call

    2) Do they not have to call me first to explain how much if anything they intend to deduct for anything.

Yes - in writing. They also have to show you the quotes.

    3) Who has enjoyed the interest as I have have been in the same house for 8 years plus. Can I ask for any of it to be paid.
What did you agree to in your first AST? Have you signed any subsequent ones since? If 8 years ago, you signed to agree to getting no interest on your deposit, then no, you can't get it.

    4) Any indepedent part that can give me phone support - council, Shelter or who.

Was your tenancy managed by the LA or the LL? Whilst the LA may have come round to show new tenants round, they may have nothing to do with the return of your deposit. Establish who you should be writing to, & then write. What did it say in your AST about the timescale for return of the deposit?

A couple of other questions to help posters in addition to Sooz's questions.

Have you renewed your tenancy onto another fixed term since you moved in, most importantly since from April 2007 or had it lapsed for the last number of years onto a periodic tenancy? (i.e. trying to establish whether the agent or LL hold the deposit or whether it has been protected in a scheme or possibly should have been).

Did you sign an inventory when you moved in? And a check in report?

In the 8 years, have they undertaken any inspections and ever raised any issues with the condition of the property?

When you moved out, did anyone undertake an inspection/check out with you present or are you aware of whether any inspection was undertaken since you left?

Edit, and another quick question, did you serve the required notice when you left and pay the rent up to the date of leaving

Has there been any communication of any sort between you or the LL/Agent since you moved out? If so, what was it?

Who was managing the property, agent or landlord?

Any communications now should be in writing between you and the LL/Agent but if you post back more info then I am sure you will get more detailed advice.

    Tenacy managed by LA.

Nothing in AST regarding timescale for return of deposit.

Originally a 12 months period but after which just kept rolling along with no formal renewals.

On the day we left someone came came to see us out and took a look around and just kept saying how well looked after and clean we were leaving it. We know the LA was meeting the LL at the house within days to agree what needed doing before re-letting.

Had an inventory when we moved in but never signed for and sent to us after we moved in. No check in report.

When we moved out we asked if we could meet someone (LA) to go round and agree condition but were told their procedure was that they looked after the tenant had moved out. I did get an independent witness to inspect thoroughly just before we moved in case I needed a witness.

We gave two months and ten days notice and have never been late with or missed a payment. We had no outstanding issues either way on house or rent payments.

No communication with LA or LL since moving out.

    LA fully managed.

    Hi

If you are confident that the property was returned in the same condition in which you received it (fair wear and tear excepted - I would expect that to be fairly significant if there were no major repairs/redecoration etc during the time you were there) then I would write to the LA (and if you have the LL address send it to them too) stating that since your have had no communication since you left in respect of your deposit and that you consider the property to have been returned in the same standard as you received it fair wear and tear excepted you request that your deposit is returned to you within 7 days of the date of your letter. Send it recorded/registered post, just keep the letter simple. |Check it is delivered and signed for by tracking it. You could state that if it isn't returned within 7 days you will issue court proceedings but personally, I would refrain from that for now. Who knows, you may be lost in their system somewhere, unlikely but possible.

If you receive no joy or response, then let us know. The LA/LL would have to demonstrate any deductions by way of receipts etc.

    Good luck

  • Well - sent two emails since my last post and just called LA again to check wherabouts of deposit. The girl said she would get someone to call back so I will wait and see.

I tried calling my County Council then County Council for advice but they said to call CAB which I may try on Monday.

I could call the LL but can I ask him to send me his cheque. Why do I need to wait for the inefficient LA?
