Remember if you record any conversation you HAVE to advise them prior.
Denial is the best method of attack when it comes to insurance. Just because they 'say' they aren't liable, does not mean it is so.
You've purchased insurance in case the worst happened and the goods you paid for, for a certain purpose were covered. Tesco, being the replacement company are liable to ensure you get a product which is the same or similar to the product you purchased (bearing in mind the original product was suitable in the first place).
You need to check your insurance policy to the bare bones, and get onto CAB (citizens advice bureau) before you do anything else. Obviously I'm advising in the dark as it were, so anything I'm saying needs to be taken with a pinch of salt until you read/post the policy.
It IS likely to be Tesco I can hold responsible then?
Thank you for that. Going around in circles and hearing repeated "No, talk to those guys" you start losing track of who actually IS responsible and who honestly doesn`t need to be involved.
I`ve actually sent emails off to both ConsumerDirect and Trading Standards tonight. CAB will follow on monday I think.0 -

That would have been fixed when they reinstalled Windows though, surely?
(And I am at least confident that they did that, having been through the Event Viewer with a fine toothcomb. It`s also showing a disturbing amount of graphics drive failures in there).0 -

Sorry - I think you misunderstand!
The laptop was sent to me last November in response to an insurance claim after my beautiful brick of a Targa had an accident on a train. The original supplier is either Tesco Insurance or Powerplay Direct, depending on who is trying to disclaim responsibility.0 -

Oh, the original model was a Targa. I don`t think I actually have the details for it any more.
It`d be a bit late to not claim from house insurance now - Tesco took it away and destroyed it before they sent the new one!
EDIT - if it helps though, the original warranty didn`t apply due to the nature of the damage rather than the date - the poor thing was in it`s laptop bag on an overcrowded train and a passer-by stumbled on a turn and bye bye laptop as it got a good kick. Didn`t discover the damage til I got off, but no-one`s fault really.0 -

Do what I said earlier. Bear in mind they're going to deny where possible and contact CAB. If you're feeling particularly daring say the words ' not fit for the purpose it was purchased ' when referring Tesco's replacement for the original laptop (bearing in mind it needs to be similar or better specced) and see what happens.

Yeah - I`ve contacted them before for employment issues (an employer not paying redundancy pay) and they were absolutely great. Definitely on my call list next week I think.
