Nestle Boost Sony Laptop - Help PLZ (they sent me a lower value Prize than in T&C)

Good news is that in mid September I won in their instant win promotion a sony laptop.

Their terms and condition state the model of the laptop prize which is FZ21M.

Waited 5 weeks for delivery and then was surprised because they sent me another laptop AR71J. (I believe the FZ21M is discontinued from doing online searches as its an old model now).

The problem is the one I received has a lower RRP than the one I should have received plus it lacks major features and specifications that were included in the FZ21M (eg. Blu ray drive and Intel Core 2 Duo Processer).

I contacted Nestle by phone and the promotions agency by email and told them that in their terms and conditions they state that if a prize is not available they have the right to replace with same value or higher. They then took some details off me and the promotions agency responded to me today (took them a week to take action).

The Promotion agency sent me by email the following today:

Thank you for your e-mail.
I have discussed your query with Nestle themselves and we are in agreement.
We acknowledge that the features and software may differ and appreciate your query, but we have supplied you with a prize of greater retail value than the model that was listed in the Terms & Conditions. Discounts and price promotions may mean that your search online did not reveal this, but we have sourced both models from a single supplier and the replacement prize had a greater value.

Unfortunately we cannot therefore justify replacing the prize as we have fulfilled our prize obligation.

This is totally rubbish and NOT TRUE.

The retail price of the original laptop that I should have received I'm SURE is greater.

The AR71J on sonystyle website is currently £649 including VAT.

But as the FZ21M is now discontinued I can see from other websites that its RRP is £900 or £800 but not less than that. I'm pretty sure.

Now what action is best to take now? Contact SONY to get proof in writing regarding the RRP of both models or what do you suggest?

  • Your best course of action would be to contact the ISP, who will make contact with the promotor for you and demand proof of the prices.

HOWEVER, chances are that this laptop is of greater value on their supplier's list, which is all they are guaranteeing. It's not like promotors can shop around to get the best deal... they have a contract with a supplier.

Good luck, and either way, it's a free laptop!

I think that you should be grateful that you have won a laptop in the first place! I would love to win one!
