I agree with some of the posters on this thread. If you are getting regular cash or otherwise payments and you are going to claim means tested benefits such as Housing Benefit (now Local Housing Allowance for private lets) you would have to declare this otherwise it would be fraud. I dont know about tax credits but I think that has been covered.

Gifts from your family dont tend to count as income for any benefits as far as I am aware. I dont think this can be seen to be a regular source of income.

Tax Credits would not class this as income even though tax credits is means tested.

However if you were saving it and it was over the income limits £6k, £16k or whatever the limits are, then you would need to declare it to the appropriate people.

He is paying half her rent every month! How on earth can it be classed as anything but regular income?

OP - the money almost certainly will count if you were to claim HB, and if you were to claim and take the money on the quiet, you would be leaving yourself open to prosecution for fraud.

heads up for a clear, unequivocable fact:-

This money would be disregarded as income for HB purposes.

It used to be treated as income, but this was changed about 3/4 years ago. it's classed as a volutary payment.

  • Its not taxable income, it doesn't count.

I meant to say a steady source of income rather than regular.

If he was to stop paying as they had fallen out or if he was no longer able to afford it then it could cause problems.

Anyway, regarding benefits other than tax credits I was giving an opinion.

I would declare it to any benefit agency/organisation anyway to be on the safe side.

There is a bit more detailed information for HB & CTB claims here:
    http://www.dwp.gov.uk/housingbenefit/claims-processing/operational-manuals/hbgm/parts/ptbw_02c.asp#b_w2610

Scroll down to W2.615 for detailed advice and some examples.

From this it would seem that you should tell the officer assessing the benefit but they should disregard it as income - if they don't then I would point them in the direction of the guidance.

As it would if someone lost their job or their savings! It's an uncertain world.

It's not grey at all. it's black and white. It's a voluntary payment therefore it's disregarded.
