  • My Dad has racked up hugh debts. He has already remortgaged against his house. He still lives with my mum and the house is in joint names, but apart from that they live seperate lives. She has savings, not huge, but enough to support her in her retirement. What I want to know is my Mum liable for my Dads debt if anything should happen to him.
  • You really do need to see a professional to get correct answers to this issue. I'm not a professional but I can tell you that if your father died his debts and assets would be put together with his interests in the house and your mum would either have to buy your fathers share in the house, or she may have to give it up where a court order would exist.
    You do need to get professional advise, or more to the point your mother needs to do so. Advise from anyone else, me included, will never be 100% correct.

  • My husband and I have had a small business within the construction industry for 12 years. Last year the business started to struggle to find work and things slowed down considerably. In August of last year we could not meet out VAT bill from the previos quarter. Owing approx £24000.00. we inform HMRC of not ba able to pay, but they just said they would shut us down if we didn’t pay up in 7 days !!!! We have since closed the Limited company down, but we had a overdraft of £20000.00, in August 2005 we apparently signed a personal guarantee for this amount and even though the company is no longer trading we have to pay this amount. We have opened a small caf!/bistro near to us in the hope of earning some money to pay our debts which seem to be spiralling out of control. The caf! was very expensive to open and it is just about holding its own except we are not able to take a wage from it. I keep getting bank statements about the old business account and they are charging us about £300 per month in interest and charges, we do not want to go bankrupt because we may loose our home (which is mortgaged). In the last 7 days I have had a letter of my mortgage company, that the interest rate will now be 6.99% (we did agree to this when we took the fixed mortgage rate) My mortgage had gone up from £1395 per month to £1655.00 per month, I work for another firm but may wages will not cover the mortgage let alone any other bills.

    hi, is it true that if someone cant make the agreed monthly payment on HP and they offer a lower payment per month chances are the company will accept this?

    can anyone advise the best way to repay £38000.00 of debt from credit cards and loans etc...really stressed and dont know where to turn to for the best help???

    gosh, I am so slow. when i click on thread tools/thread starter it only gives me 3 options : show as print format; email or subscribe to thread. i can't see where it says start new thread. help again !:A thanks shoe gal - can you direct me again!
