Hi, Just wanted to know if anyone could help me. My mother died in July this year, she had a catalogue with GUS which was taken out 30 years ago with Marshall Ward. I have written to them to ask if they would write off the balance of £400 and they said no. So i asked for a copy of agreement, they have sent me a copy of a budget account agreement taken out in 9/05 for 100 weeks. The way i see it is this agreement was for only one purchase and has been paid for. The account was up to date at the time of her death so i believe they have no agreement for the remaining purchases made. What can i do?

Well, even if this was money she owed to the catalogue firm, you have no responsibility for it. It would have been her debt and it died with her. If they want to sue her estate that's what they'll have to do.
If your Mum paid off the purchase then where does the balance of £400 come from?

Hi
Some questions
Is the debt just in your mams name?
Who is the executer of her estate?
Did she have any assets on death?
Usually the debts are paid first before any pay out is made.

It would have been her debt and it died with her.
Not strictly true.
If she had assets, all her debtors (mortgage company, tax, etc) gets in a queue and takes their due. Any left is split as per wishs of will.

The £400 balance comes from other items she purchased later. the agreement they sent me is for £827.01 paid over 100 weeks at £8.27 signed 26/09/05.0

It was in her name only and my dad is the executer, she left £4000 but after funeral ect very little left.0 -
This debt is unsecured then. Was there a credit agreement signed?
I woudl try this first :
I would photocopy the death certificate and send a covering letter explaining that your mam has passed away.
Wait on a reply. Depending on the credit agreement being signed they can make a claim on whats left on her estate. If there is nothing (assuming your dad cna prove this with receipts) then they will probably drop it.
The executer (your dad) as part of his role is to pick these issues up.

The agreement they have sent me is not for the balance now owing it is for a previous purchase. £827.00 over 100 wks at £8.27 per week. They have not provided an agreement for the balance now owing. Kath0 -
Are you in receipt of the goods they claim you owe money for?
