additional maternity leave

Right we all know we get 39 weeks paid maternity leave and 13 weeks unpaid.
Having to contact employer 8 weeks prior if we want to return to work earlier than the 52 weeks.
So..
My question is. If I take the extra 13 weeks will I still be entitled to WTC.
I know I will still get CTC but I wont get Maternity Allowance (i dont qualify for SMP, even though I am employed)

If you take additional maternity leave you will no longer qualify for WTC.
You must be in remunerative employment to claim WTC.
The only exception to this is when your employer doesnt pay you sick pay or if self employed and off sick. Even in this case you would only be classed as being in emplyment for up to 28 weeks.0 -
So for talking sake.
I would have to get a sickline for the 13 weeks to get WTC
( dont moan anyone I know its probably not legal)
But other than that I would have to call WTC to get my WTC stopped for the 13 weeks (even though im still classed as employed just not being paid) and then call again once I start working/earning a wage.

Yes but doing this would cause concern with your employer.But other than that I would have to call WTC to get my WTC stopped for the 13 weeks (even though im still classed as employed just not being paid) and then call again once I start working/earning a wage.
