Official Receiver Interview

has STILL not happened! I was made bankrupt on Fri 3rd October and was told by a clerk on the phone that the OR would call me the following week to fix an interview. I had to chase them the following week (Thursday) to be told my OR was going to have a phone interview with me and that he would either call me that week or the next. This is now the 3rd week and still no phone call to even fix an interview time and date. Just wondered - has anyone else had this? Mine is at Leeds. Of course ideally I'm hoping he thinks I'm such a sad case he's discharged me immediately - but realistically I know that isn't going to happen.

any thoughts anyone?

  • Hi and welcome!
I wouldn't worry too much about the OR interview - if you were a complicated or questionable case they would have prioritised you!

They are soooo busy at the moment that any straightforward cases seem to go to the bottom of the pile. Do you think you'll get an IPA? If so then give them another call, otherwise if it was me I'd leave it for them to make contact!

All the best in your new, debt free life! CBx:D
  • Hi:-)

Read your story. I too went bankrupt a few days ago. And haven't heard from OR. So are you going to ask him not to contact your landlord then? What's your tenancy - assured? Mine is and I am still worried it might course problems..What do you think?
  • I would tend to think no news is good news and if you are employed it also leaves less time to implement a nil tax code. You are nearly 2 months in and will be discharged in just over 10 months. I'd relax and get on with enjoying life. Is there anything specifically you are worried about? Maybe we could put your mind at rest.

I do agree with Chelseabun - the OR must think you are a straightforward case or he would have been in touch. Do you have a car, anything on HP, does your SOA have more than £99 surplus?

Have you had various paperwork to sign and sent back to the OR? The covering letter to this is usually the one that confirms interview date/time, or states if the OR has decided that no interview is needed at this moment
  • May I gate-crash?
I went BR in August. Completed forms to sign etc and sent back asap. Got two letters informing me that car and home contents were exempt. Almost 4 months on and still no interview!
I'm just a little stressed waiting.
Is an early discharge possible without an interview?

If your forms were all filled in correctly and your reasons for BR explained in full then it is possible you won't be having an interview. For early discharge though I think they send you some forms (IPAQ or something) to fill in and return. You can always check the individual insolvency register (just type that in Google and it'll come up).

In that case there will be no interview. The letters sent regarding the exemption would have been given as instructions to the case clerk when the examiner was writing up the case as a type zero (no interview). If you check the letter sent to you with the forms to sign, is there a bit saying "decided no interview at moment, will contact if need to" type phrase - it's quite easy to miss.

And can get ED with no interview.
  • Thank you JCS1.
Really kind of you to reply so soon. Have just been reading about case 0's actually http://www.insolvency.gov.uk/freedomofinformation/technical/casehelpmanual/I/InitialContactInDebtorsPetitionCases.htm
so it does look like I am a case 0 then. Thats a relief as I was worried something was wrong.
Now last question: Hubby and I are having a temporary seperation to see how things go, shall I write to OR with new I&E etc, or just keep quiet and plead niavity? I'm no better off (worse off actually) and so is he. No IPA been mentioned as yet. Confused:confused:

You have 21 days to let them know, so keep quiet for that long to see how things go.
  • Thank you fiveyearplan, just saw your message.
Yes, I've heard of the forms they send, so fingers crossed I get these and can start to breathe again! My case was very straight forward. £12k of personal debt, two babies close together = 2 lots of stat mat pay and being silly by relying on house to gain equity to clear debts (it didnt!).
