That's under different circumstances. He would have had no reason to open somebody elses mail.I am a Mortgage Consultant and don't like to be told what I can and can't put in a signature so long as it's legal and truthful.0 -

Read the act properly:
128. Subsection (3) makes it an offence for a person, intending to act to a person's detriment and without reasonable excuse, to open a postal packet which he knows or suspects has been incorrectly delivered to him.
So once delivered it is only illegal IF (a) you are doing it intending for the detriment of someone else, (b) without reasonable excuse.
I usually open letters arriving at my house adddressed to other people - I want to know what my address is being used for. Particularly in these days of identity theft if someone uses your address for fraudulent purposes you want to know about it. It perfectly legal to open mail addresed to your address.I am a Mortgage Adviser
