    I have been off work sick, so I have not got the full amount of wages, for the past 4months work have paid me late, resulting in no money being in my account when direct debits go out, I have a overdraft facility of £1000, with being into it by £997.30, I have just changed my direct debits to later in the month, although this wont take affect until Jan.

    I have been to the bank today to discuss my options. I cannot increase my overdraft as I have previously been over it, she said the only options are to take out a loan at 24.9% for 36months at £38 per month, or to take out a premier account at £25pm for the account, to get a 7.9% interest rate for a loan, I have moved back in with my mum to help get back in the black, and i believe i will be ok after 2 months of getting £700 which bills per month is £400 (or less) so i dont know what to do in the mean time until then?

    Its also worth saying my current wages are salaried, £7900 pa with 3hours, £658 then tax deductions after that, i am currently looking for a new job

    Could you please suggest anything other than a loan, or at least a cheaper loan.

    any more advice i rang your cccs, with my case number as you hav been giving me great support over the last 7 months,but unfortunatly your lines were busy and they said someon would ring back but as of ye i havnt had a phone call

    Hello,

    Unfortunately there is no way of making the creditors stop the interest and charges. Mercers are part of Barclays, they are their internal collection agency.

    If they do pass the debt onto power2contact, they are not a bailiff and don’t have the power of a bailiff. So if they do come to your property you can ‘kindly’ ask them to leave ;)

    I will suggest you continue to make your payments and stand your ground. If they are unhappy with this, they will probably pass this debt onto another collection agency where you may have more luck.

    If you would like another appointment to see if there are any other option available to you, you are more than welcome to have another appointment. The phone lines have been extremely busy lately so it maybe better to try quieter times such as mid morning or mid afternoon.

    Hi, guys,

    Not sure if this is the right place to post this but i need help.

    To cut along story short, my girlfriend lost her job 2 years ago, as her company went bust, so she last a whole months wages. We went £1900 overdrawn with HSBC, things got worse and 2 other account went overdrawn as we tried to make ends meet.

    In the end HSBC were charging £150 fees on each account but still paying the DD's. We just let them as the bills were being payed. We ended up best part of £5000 overdrawn in total on all 3 accounts.

    We decided to move our wages into another bank, so we could try and sort it. We paid off £3000, which we got from Family help, then have been paying £30 into each account, each month.

    Today i got a final demand letter, for one of the accounts, we have tried to talk to them and have been messed around, like the said they would call us and never did.

    This amount is £890 but we own £1900 in total, i spoke to them tonight and gave in all our outgoings, and even thought i paid them a total of £90 each month for the 3 accounts, they say they can not help, and all we can do is do an IVA.

    We are just keeping our heads above water, and not gone behind on another bills, such as mortgage etc but really struggling to afford to buy food, but to us the bills are the most important thing.

    They say that if i dont sort it with 7 days, they will take us to court, over £1900 and get the debt collectors in.

    We dont want to do an IVA, can they make us over £1900? and do you think they will take us to court, even though we are paying money into the accounts and not using them?

    Any help would be great as they have done a great job of scaring us.

    Hi Mark and Jo,

    Don’t worry too much about this, sounds like they are just putting pressure on you to see if you will pay them anymore money.

    It’s interesting to see that they have recommended an IVA! An IVA is only applicable for a very small percentage of people.

    If they were to take you to court, this could work in your favour, they will be referring to a County Court Judgment. Even though this would stay on your credit file for six years, it will give you the opportunity to make an offer of repayment based on your income and expenditure, so it will always be an affordable amount and possibly less than you are paying now if you are struggling on your current budget.

    You may benefit from having an appointment with ourselves, as we will be able to help you put together a realistic budget and see what your best options are.

    A CCJ will go on the individual not the address. Who have you been asking to update the address?

    The only people that would be able to update your credit file would be the claimant so this would be the solicitors that act on behalf of the creditor; this would also help if they were to send any correspondence as it would ensure that you receive it.

    Managed loans have a very high interest rate. I would advise you just to leave things as they are, and just stick to the reduced payments through the dmp.

    Unfortunately no, the situation originally arose when I was made redundant and could no longer afford the payments.
    I am in a much better financial situation now though and could make adequate monthly contributions, I'm just not sure where I stand after so long.

    Thank you for help. I cannot remember the name of the form we filled in, but we did admit owing it, and we did make the same offer we are already paying. There was nothing else from the court but the CCJ with the payment required on it.
    Went to local court today for suggested form to appeal and bring case to local court, found out we have to pay £35 to file this too. Intend to complete over the weekend and take it in Monday morning.
    Also with the original forms to solicitors was yet another I&E form, we sent them 3 in total.

    You will need to complete a form called a N245, there maybe a fee for this depending on you circumstances up to the value of £35. The N245 will give you the opportunity to put forward your income and expenditure and make a new payment offer.

    You can collect a copy of the N245 from your local county court or print them from this website http://www.hmcourts-service.gov.uk/HMCSCourtFinder/FormFinder.do .

    Once the forms are completed, you will need to take them back to your county court and the payment will then be re assessed.

  • I have sent Cabot Finance who have purchased an old Credit Card Debt a request under the Consumer Credit Act to have a copy of my CCA with them and a statement with all my payments and their charges. They have come back to me a stated they are not obliged to provide this information, but they have requested a copy of the original agreement with the original lender. They also returned my £1:00 fee and did not send me a statement. Are they correct?
