  • quick one im wondering if i can get answered....got a card with argos last year, due to some circumstances ended up stopping the payments (was just before december this happened) where do i stand with this one? at the moment im not contacting them and they have added a hefty load of extra money ontop of it :( if im right to belive the CCA would be useless? i mean am i able to still send it of?? or is there anything else i can do about the silly amount of intrest they have added? please advise im at a lose here and cannot stop thinking about it :( thanks!

    As the card is after April 2007 you cannot invoke unenforceability (s.127(1)) so sending for a s.78 CCA Request is fruitless - forget this route.

    To stop interest etc you need to either wait til it is sold to a DCA or enter into a payment plan and negotiate the freezing of interest/charges but that does mean making token payments, naturally. :D

    Hi Sarah ,

    Thanks the reply, I rang RBS directly and they say it was accepted on the 16the Feb and is valid for a year. i made the girl double check so fingers crossed its ok. i'll probably double check again in a couple of weeks.

    Hi razor,

    A CCA should be used when you are being chased for a debt when is not yours, not to avoid paying. If you are having difficulties then the best thing to do is put together a detailed financial statement and make a reduced payment based on this, then you would be able to negotiate with them to get the interest and charges stopped.

    If you would like any help completing a financial statement and for the CCCS to take a look your options then you can call our helpline free on 0800 138 111. Or if you would prefer we do have a free online debt advice facility called Debt Remedy – you would just need to input your own in come and expenditure in here.     hiya all

    i wish to sort out my financial nightmare but now have been made redundant and thus will be now making an appointment with the dss to at least get registered as unemployed and see what benefits i can get

    but hubby is still working full time - dd at college still in education for the next few years

    now i have a few concerns

    my own sole debts with credit cards are with dca and creditors been trying to get to grips with it all

    i have tried in the past to claim bank charges but now getting letters due to the nov court ruling they are not going to pay thus my questions

    1. can i now write back and say ive lost my job though the bank accounts are joint two have overdrafts that the bank charges would clear instantly for us barclays and halifax - another was with rbs which was closed but only about 300 max of charges
    still get a few charges but have tried really hard to not get any for a long time ((Would this now fall into the hardship type scenarios?? )) Guess now i have to recontact each bank and explain this now and see if they pay up or if i have to then go to the ombudsman?

    2. i need to look at all my creditors and currently investigating the cca's on all and have not claimed yet the credit card charges but im looking at this as part of my clearing these debts

    3. I have had a bit of redundancy pay but wish to secure this to pay our mortgage for the next year as hubbys overtime is being cut - would this go against us?

    just my thoughts for the time being but i will start my own thread once ive had some initial replies

    My husband and I have been on DMP with the CCCS for approx. 3 years now. We missed our December and January payments due to high unexpected costs (family dog diagnosed with Osteosarcoma, subsequent vetinary bills) but made our February payment on time as usual.

    This morning we have received a County Court Claim Form from one of the creditors, the full amount outstanding is just under £800 and there's no way on earth we can afford to pay it off: what should we do next..?

    A CCA should be used if you are being chased for debt that you do not owe, if you are having difficulties you need to put together a financial statement and make an arrangement based on your budget.

    I would recommend that you have an appointment to discuss this in detail. If you would like an appointment please call 0800 138 1111.

    Hi Razor,

    A token payment is an amount you can afford to pay based on your budget – this could even be £1 per month if that’s all you can afford to pay. You would need to put together a detailed financial statement and send this to the creditors in writing to back up the “token” payment. Another name for a token payment is a goodwill gesture payment.
