i need help and advice , im really struggling to know what to do ?
I have been struggling with massive debt for years now , untill last eyar when husband made redundant we were managing to scrape through paying small payments etc . we owe approx 65K in mostly unsecured debt .. half the amount each , my husband is a nightmare with finances and ive had to deal with every thing for 13 years our relationship is at breaking point . We have tried dmp with ccs and failed as husabdna has no regular income and cant make monthly lump sum payments . so since then we have been making £1 token payments . . We now have a couple of ccj each and i have been given a charging order ?? i tried to argue against it but to no avail ., last time a spke with ccs i was advised to go bankrupt this was last year and my husband totally refused . I started a degree last year and now recieve grant and loan so im worried this will be taken off me if i go bankrupt too ? . i have no money in my property and am in arrears with mortage payments and 3 children to support . husband self empoyed and doing ad hoc work so no regular income .
I wanted to go bankrupt myslef anf leave him and try and start over but i dont know waht to do ? .. Ive tried to look what this charging order means to me but i dont understand it , if a go bankrupt wll this still remain ?? ..0 -

Put together a budget showing your income and expenditure. This will show realistically how much you have left after paying all your priorities.
If you have other debts then work out payments to each creditor on a pro rata basis so they all get a fair share.
Send a copy of your budget and full list of any other creditors to your husband's creditor and an offer of payment you can afford based on the above.
If they refuse your offer, send it anyway.
You cannot pay them money you do not have.

If you are on a DMP with us then we will need a copy of the collections letter if the debt has been transferred to a collection agency so that we can contact them with an offer of payment.
If you are paying money into a bank account where you owe debts, then we would recommend that you open a basic bank account elsewhere.
A basic bank account would not have an overdraft facility.
This is to put you back in charge of your finances again and prevent the bank from taking money from your account to pay their debt.
There is a good section here on MSE regarding reclaiming bank charges. I have attached a link for you. It gives template letters you can use and what to do if your claim is initially refused.

Hi Sarah
I would recommend that you call our Debt Remedy team to see how your plan is progressing.
We only need up to date statements from each creditor and if they have been passed to collections,we also need these letters.
The helpline number should be on the booklet with the other advice.

Hiya All
Juat wondering if anyone can give me any advice please, Ive waited nearly a month for my telephone interview with CCCS which was to take place at 15:45pm today,( ive had an awful time with multiple telephone calls from creditors during this time and felt this was my light at the end of the tunnel ) ive taken time off work to be available and have waited until 16:30 with no call then just had a call from CCCS to cancel my appointment due to sickness and ive now been informed i have to be re booked ?? im so upset as i really cant wait much longer im so stressed its making me ill and im now frightened to answer the phone or any mail , surely someone else could take the call ??

We are extremely busy at the moment and if another counsellor had been available at the time,then we would have booked you in with that counsellor for your appointment.

In March 2007 I applied for an IVA through Debtmatters. During the application process I was advised to transfer my mortgage to 'interest only' as this would reduce the monthly payment and bring the outgoings inside the allowed amount. This I did but I am concerned that at some point I need to revert back to 'repayment' in order to start reducing the capital otherwise I will need to sell my home to clear the debt which is something I tried to avoid doing by taking out an IVA!
During the application process I received correspondence from one of my debtors advising me that they were taking court action - I immediately contacted Debtmatters who instructed me to fax the paperwork through to them and they would deal with it - I did this and assumed they would do so. I heard nothing more from the company until a document arrived from the court advising me a legal charge had been placed on my deeds!
However this debt is showing on my paperwork as being part of the IVA. I again forwarded all documents to Debtmatters who assured me they would deal with it but it would appear they did not as I later received a letter from a company advising me that they had purchased my debt from the original company and were now chasing me for payment. I have also received correspondence from Unique Business Finance Ltd who tell me they are now my Supervisor - this is the ONLY time my supervisor has ever contacted me.
Sorry for being so long winded but my questions are:
Should/could Debtmatters have stopped the court action prior to my IVA court date?
When it comes to releasing equity in my property to clear my outstanding IVA balance can I transfer my mortgage back to repayment before I take a loan so that my outgoings stay within the boundary it is at present (my mortgage payment is £800 pm and IVA £550 - transferring to repayment will increase it to £1250approx so there will be very little left for additional loan).
Was is legal for the company to sell my debt even though it is part of an IVA? (It also appears that a legal charge was put on my deeds just before the IVA was finalised but it was still included in the IVA.
Am I allowed to refuse to take an equity release loan if the interest rate is too high and is likely to put me back to where I was when I started the IVA?
If I am unable to find a lender to provide me with the required equity release loan what will happen?
It seems unfair that the adverts say you can be debt free within 60 months when this only appears to be the case if you are not a home owner! I took out an IVA in panic and relief as I thought it would help me with my financial mess however it seems that the further I get into it the longer it is going to go on for - at the moment I cannot see any light at the end of the tunnel - just constant debt and court cases! I never expected a magic wand but neither did I expect to stick to the agreement for 5 years and still risk losing my home at the end of it!

I'm sorry to hear this.
In most cases we can find another counsellor to take an appointment if somone had to go home ill but it's not always possible. Did someone book you in another appointment soon for you? If we've had to cancel the appointment we can normally accomodate another call to suit you. If not, PM me an I'll try and get something sorted for you.

Hi there.
I think you will probably benefit from having another appointment with you so we can talk you through your options in greater detail.
You wouldn't need your partners permission to go bankrupt if you decide to do it, as it's something you would have to do on your own anyway. It's not likely to affect any student loans or grants you might get through yout degree.
A charging order is where a creditor has secured the debt onto the equity of your house, so if you choose to sell, they get their money back. It would be written off in bankruptcy, assuming you have little or no equity in your property.
I think it's definitely worth giving us a call, if you've not spoke to us in the last 6 months you'll need to call our helpline to re-register on 0800 138 1111.
