Hi Sue,
I've posted this elsewhere on the forum but wondered if you could give me your/CCCS's opinion too please. I just want to get things straight in my head now so that I can plan for the future - not said that for a while!

Hello,
The point of a CCA request is to prove that you don’t owe the debt, not to try and avoid paying. For example if you were to receive a letter completely out of the blue for a debt that you hadn’t taken out, this is when you would send the creditor a CCA request.
We would still keep paying the debt until absolute confirmation that the creditor cannot supply the agreement (multiple attempts by client to get this from creditor); we would also get the client to get some legal advice on this to confirm there would be no come back further down the line. If a creditor cannot provide an agreement and confirmed this then in reality the debt is not enforceable.
You would be able to offer full and finals, the money that would normally be paid towards that debt would then be split between your other creditors therefore reducing the term.

I have been in a DMP with you guys for some time and all is going well, I hope to be debt free in 2011.
I have two defaulted accounts left on my credit history which will reach the six year mark mid 2010 (original default date), but I will still be paying these off when that time passes, and will be for some time after. What will happen to them? Will they still be wiped from my history even though they are still not settled? Both the accounts are with debt collection agencys now, but still have the original default date of 2004..They both sit on my files like any normal account would, with the balance's decreasing every month but obviously showing as in default..How can the defaults be removed if both of the accounts still have activity on them?
Its really confusing trying to decifer all three reports as they are so different in format, I'm trying to plan for the future with regard to repairing my history and get a basic idea as to when I might be able to start living my life again..0 -

We're on a DMP with you and our existing mortgage fixed deal ends in October which means our rate will jump from 6.44 to 7.5. The company has been bought out in recent years and I don't believe they offer new deals so I don't think we have any option with them but to accept the higher rate. I plan to phone and check when I have a day off soon (it's easier to do that from home). I know you have mortgage advice people too and I plan to phone you at the same time. However that won't be until next week and I was wondering what our chances were of getting a better deal. Obviously any money saved will go off the DMP and I'd rather that than pay more to the mortgage company.
I spoke to the financial advisor we used in the past and he thinks we're unlikely to get anything because our equity isn't good (we have a first plus loan - grrr).
We owe around £105600 on the mortgage
First Plus is around £56000
I believe the house is worth around £160 - 165K
Are we stuck with the same mortgage company and therefore stuffed and have to pay more on the higher rate. Or is there a chance of finding something else at a better rate?0 -

Glad to hear the plan is going well!
The default will be removed after 6 years but your credit file will show that you still have a payment arrangement in place.

We are unable to advise on this as it would be entirely up to the mortgage lender and what deals they have available.
However, as your financial adviser has advised, the fact that there is no equity in the house may mean it could be difficult to get a good deal.

Thanks so much for your advice but i have a few questions hope thats ok ?
Iva applied for a basic bank account just waitin to hear if accepted so fingers crossed , ive written a letter of complaint to MBNA just waitin for there responce,
Ive got my telephone interview with cccs on 7th Sept , should i be sending letters to my creditors explaining my situation if so has anybody got any template letters ?
Also my biggest stress is my Natwest credit card ive missed 3 payments now ( i seem to make payments to the most hassling creditor and im sorry to say forgot about Natwest as they have been quite quiet until now) yesterday i recieved a defult notice asking for a payment of £150 in the next 7days, i really havnt got that amount of money to make so what options do i have ?? i basically got paid 2 days ago and once my bills mortgage etc plus my 2 loans (which i have never missed a payment on ) i will be left with £150 until my hubbie gets paid on 9th sept,my car tax is due this month so once that is paid it will leave approx £70 which will have to pay for petrol, food everything so i really have no funds to make any large payment to any of my creditors ? its giving me sleepless nights and ive now took to unplugging the phone my telephone interview is still 2 wks away so would appreciate any advice

Hi CCCS coucellors,
We have just set up my DMP with yourselves and are due to make our first payment to you in September. My OH has found out today that he will be expecting a cut in salary of around £250 per month from September. I quite honestly don't know what to do now, our plan is only just set up so I don't want to start changing things as the creditors haven't even had their first payment yet. Hubby is desperately trying to find a second job to try to make up the shortfall but in the current climate, he's not holding out much hope. We don't know at this time what his pay will be and won't know til the end of Sept. I am considering changing our mortgage to interest only for the time being rather than go changing things with the creditors so soon. Can you please advise what I need to do as far as my DMP goes if I change my mortgage over.
Sorry to waffle on, feeling pretty stressed at the moment.

Hi
I am on a debt management scheme and have been for two years. However, I recently had to lower my monthly payments due to my hours being reduced in work.
Now I have received letters from two debt collection agencies demanding immediate payment for two seperate debts.
Does this mean I am going to court or the bailiffs will be coming? I don't know very much about collection agencies!
Can you please advise?

Hi there.
You don't really need to send any letters to your creditors at this stage. If your creditors are contacting you, we would advise you to tell them you have an appointment with us and you can quote your client reference number.
As far as the default is concerned, don't panic! A default notice is a letter confirming that you haven't kept up with the monthly repayments and they are effectively ending that agreement. If you don't have the money to clear the debt in full, the default will be registered against your credit file for 6 years. They will then normally request you to come to some kind of arrangement to clear the debt in installments. Don't worry about trying to make an arrangement, that's what your counsellor will help you with on the appointment!
