Hi everyone,just joined this site after reading through about 50 pages last night about DMP's
ive now set up a DMP with cccs and now waiting for my welcome pack and i also applied for a new basic bank account with barclays which is in the process.
just a question or two, i have a car with black horse on finance,is this included in the DMP as its on finance or will i have to set up a new direct debit when i get my new account running,? also, if it is not included in the DMP and i set up a new direct debit for it,being as its black horse will my current loan with lloyds tsb be able to have acsess to my new account even if i have only set it up for black horse?
When i get approval for my new bank account should i then cancel all direct debits and switch only the ones i need which aint included in DMP?
when do i tell the bank i have switched accounts?
and finally, now that i have set up a DMP with cccs,do i continue to pay credit cards,loans etc..... untill i recieve my welcome pack or shall i just cancel direct debits and wait till my DMP is set up so i can get some money behind me.

If your car is on a Hire Purchase agreement, this should be listed in your main budget, as this would be classed as a priority, as there would be a repossession clause in the contract.
If Black Horse set you up on a standard personal loan, then this will be added to the list of creditors and they will receive a reduced pro rata figure the same of everyone else.
If your car is on HP you will need to set the DD up from your Barclays account, if it is a Personal loan there would be no need as this will be included in the list of creditors.
As long as your money is in your Barclays account, Lloyds would not have access.
When you receive your pack to go on your dmp, there will be a letter to forward on to your creditors explaining that you are going on a DMP, you could send a token payment with this as you will need to budget enough money for your first payment.I am a Debt Counsellor that works for the CCCS and have specific permission from Martin, to post on these boards to try and help those in debt. Hi I have been reading this forum thread all day and I must say I am very impressed with the quality and attention your team has given to this forum.
My situation is perhaps a bit more odd than most but I am hopeful you may have an answer. I emigrated to the Philippines in March 2008 retaining my old job on reduced pay and taking with me 9k in debt in credit cards from IF, Mint and Barclaycard Platinum.
Whilst I worked here for my old company the debt was easily managed, paying approximately 250 pounds a month leaving me with 1000 pounds a month after payments. However my company ended this agreement in July 2008 and I was forced to seek work in the local economy. The Filipino local standard of living and wages are much lower than the UK and hence I managed to get a managerial role but only taking in 650 pounds a month after taxes. This is a good rate of pay in the Philippines but it means the UK debt is huge compared to my old rate of pay.
I contacted Payplan and after we did a financial review they could not offer me a DMP as my income and outgoings where approx the same. They recommended I pay 1 pound a month token payment until my circumstances change. Given the distance and the fact I am in a 3rd world country the postal service is slow and my communications frustratingly slow with all banks so I am trying to use email.
Mint and IF have been very quiet regarding my debt but Barclay's have been very vocal with their default threats and mention of Mercer whom I have heard nothing but bad feedback about. All banks have so far though cashed my one pound token payments but not ceased interest or charges or accept my proposed payment plan.
Now I am a permanent resident of the Philippines, married with a house, car and parking unit. The house is mortgaged for 10 years but outside of that I have no other debts other than utilities, broadband, phone and cable TV. This is not a credit society and outside of our house we deal in cash only. We have little credit agency structure and banks rarely exchange information here in this country.
Having read this my questions are as follows:
How likely will the banks be successful in chasing this debt if I live in a remote country such as the Philippines?
Will they likely just give up and accept my one pound monthly payments for the foreseeable future?
I know Mercer will never call on my doorstep as the cost of such an exercise doesn't warrant it and I am sure their phone calls will be mighty expensive also.
What exactly will these banks do for someone who is no longer a resident of the UK?
I have a CCCS appointment on Nov 17th to try and get a DMP up and running to ensure they see I am serious about addressing this debt but I can only pay through standing orders out of Nationwide bank account which has no debt associated with it so my money is safe.
Any further advice would be appreciated on how to handle this being overseas and not EU based.
On a further note we are expecting our first child next July so our priorities are our house, utilities and baby. The UK debt would be very low right now on our list of priorities.

Hi we have BR las tmonth with financial problems but as we had 2 secured loans on the house which the keys have been given to the mortgage company bu what do I tell the secured loan companies as they are ringing non stop asking for immediate payment.one knows my works number and keeps calling reception and asking for me and I am starting to worry that my employer is getting fed up with it.I have told them not to ring employer but they keep doing it.
Just to clarify things, you went bankrupt last month?
If so they shouldn’t be contacting you, I would recommend that you contact your Official Receiver and ask them to contact the creditor directly as these debts will have been included in your Bankruptcy.

Hi Marcus,
The creditors may have the power to transfer the debt to an international collection agency; however this is uncommon but possible.
If all you can afford is to pay £1 a month, then the creditors can not have what you have not got to give them.
What you will need to take into account is that £1 payments are not a long term solution so other options will be looked at on your appointment when we can see your full situation.
If the debts do get passed to collection agencies such as mercers, they do not have anymore power than the original creditor, all it would mean for yourself is to just change who you are paying the £1 to.I am a Debt Counsellor that works for the CCCS and have specific permission from Martin, to post on these boards to try and help those in debt. Sarah, thanks for that, yes in a twist of irony debt collections outsourcing to call centers in the Philippines is a new trend for UK companies - mind you this is usually under the original creditor account name such as for example, HSBC centering on UK residents and not ex pats. I am not sure on local debt collection agency rules and regs here in the Philippines but I suspect the UK creditors would take a big loss on the debts if they did sell them on. One pound is really only short term until the new year as we have to pay my visa costs, Xmas etc, we expect to go to about 10 to 20 pounds in the new year once we review the situation. Considering that workers in the Philippines get on average 50 pounds a week before their tax this would be considered a very good repayment here and not something a local agency would reject based on what I have seen so far.0

Hi, I'm a newbie to the board - I have a DMP arranged with help from the CCCS and it has been in place for 2 years, all going well.
I previously had a loan with Tesco PF and was told that I HAD to take out PPI, so feel I was mis-sold the PPI and want to claim it back.
However, I am a bit reluctant to contact Tesco PF as I am paying them back under the DMP with no interest and am worried that if I attempt to reclaim the PPI back, they may withdraw from our agreement.
Any suggestions please?

Ok guys, firstly what a great resource:beer:
Secondly, I have actually stumbled on this resource quite late in the day, but hopefully all is not lost
I have recently been contacted by a debt agency who are making claim to an aged debt from a bank (2003 - when taken out). The original amount borrowed was approx £18k for consolodation purposes.
I am seeking some guidance as to how I should proceed.
I have requested the CCA as per another Google search before I stumbled on this site. This was carried out on the 23 September 2008. No futher communication was sent.
I have since received a copy of the CCA, received yesterday, which by my reckoning is some 6 weeks after my request and well ove the 30+2 days.
The CCA does have my signature, but is in the following format:
1st page: Limited T&C's - my signature / their signatory
2nd and 3rd pages: Other T&C's.
The amount claimed by the debt company is approx £29k. I am shocked at the amount as I had made a number of payments to the bank of the agreed amount and then due to circumstances at the time, reduced the amount to £100 per month with frozen interest.
Additionally, I have joined credit expert (otherwise have an impecabble record) and I can see the entry of default against me for £14k ??????
Question is, how can they be pursuing me for double the amount of the entry?
Also, what should my next move be considering the CCA request and late receiving of said CCA and the fact the amount does not reconcile with the entry on my credit file??
I should add I have not admitted any liability or acceptance of this debt to date. My account with the debt agency is on hold for 14 days.
Any ideas??? I am willing to clear the amount, but not to the tune of double the amount. I have requested an account statement, instead I was sent utter dribble.

I have received a letter today from a debt agency called Wescot for unpaid charges totalling almost £700 from the Halifax!
The letter says I need to contact them in order to prevent Court action!
I cannot afford to pay all this at once and need some advice urgently.0
