    I currently have a DMP in place with CCCS. All creditors are in agreement except one, which is Santander (was GE Money) - this relates to a car loan. They are currently insisting that we sell the car to downgrade to a cheaper one before they agree to our offer - after taking advice from CCCS and CAB we are resisting this as we need a car we can rely on (it is my wife's car that she uses for work and she needs a reliable car given the mileage she clocks up).

    During recent conversations with Santander they have mentioned suing us to recover the loan and that we would be liable for the costs! Is this really likely? I had thought that a CCJ was their only option.

    Stick to your guns with this one. I would just continue to make the reduced payments; you do not have to speak to your creditors because if it’s anything important they will send it in the post anyway.

    Sounds like they are trying to put pressure on you, if they were going to ‘sue’ you the chances are this would be a CCJ, and if that was the case then it would be based on your budget anyway, so they still would not get anymore money.

    Hi

    I have been trying to get through to the CCCS debt relief line for a week now. It either keeps me on hold for about 10 minutes or it doesn't even let me hold at all. Is there another number I can try? I want to get this DRO sorted as soon as possible.

    Hi Hayley11

    Unfortunately the demand is extremely high for this service at the moment so we can only advise to be patient when trying to get in contact with the specialist DRO team.

    Could I also ask if you could edit out the phone number as people who have not been referred directly may also try calling the line which will only make it more difficult for you to get through. The hours for the team are Monday to Friday 8.30 till 5.00.

  • I am hoping someone can offer some advice. I am in a small amount of debt (£2k). £1k personal debt to family & an overdraft with my current bank (Abbey) of £1k. I really want to clear both these debts, and open a new bank account with an HSBC (I currently hold a joint account with HSBC with my partner).
    I am looking to "consolidate" these debts in a sense so I am paying off only one loan. I just cant seem to get ahead at the moment.
    Is it possible to get a loan for such a small amount? I was considering an interest free credit card but think my credit rating is poor.

  • timwallis> Mate debts are certainly not worth talking silly action to harm yourself, suggest you see your GP for advice etc. No idea about your finances and if you have any assets, if not I wouldn't lose any sleep over it, and in the worst case senario if you have to go down the BIG B route make sure you don't make yourself B as you have to pay for it, at the very least let the highway robbers pay for it!

    If its of any help I know a few people who have not got any assets and are not going to pay a penny back, they have just let the creditors do what they want to do, worst is you get a load of Defaults/CCJ's for 6 years,

    I would be surprised in todays Worst recession since the great depression if many creditors are even bothering with CCJ's now, they have thousands of cases to go and likely to snowball over the next 6-12 months.

    Remember debts are a civil matter, you don't go to prison like in Victorian times, thank goodness we have all moved on since then lol!

    Biggest debtor is the UK government with Brown sinking the Country to its knees, selling off all the family silver ware on the cheap during the good times. Go and pester your MP and ask him to help you out but I suspect he/she will say he/she's is very busy making ammendments to expense claims dating back years!

    I have a son who is keen to use a debt clearing house which says for £900.00 it will clear his huge debts etc.
    The company is called 'First debt eliminator'.
    This sounds to good.

    Hi. I'm at wits end . I have run the DR option on the CCCS web site which recommends a DMP, paying back £424 per month for 5 years and 7 months. I then come here and read that creditors can refuse this and send in the bailiffs....I might have misread that bit but it seems a possibility. We have circa £30k of unsecured debt, plus a car lease agreement. We can manage the mortgage and critical stuff but the credit card debts are out of control. I'm unsure about the DMP vs the IVA option - can we selectively apply either to cetain unsecured debts or is either applicable for all?

    Its a big step but all my savings are in company share schemes - I can't touch them yet without a tax hit as the shares are bought direct from salary. Are they also likely to be grabbed?

    I agreed a payment with Lloyds TSB when I realised that I was having financial problems and I had to pay a set amount of money into my bank account for the overdraft and loan. I did that and am horrified that the Trustcard people have taken that sum of money from my bank account to repay the debt on the credit card. I have no agreement for them to take money out of my bank accoun, can some one please advise me on what to do as it now looks as though I have failed in my agreement with the bank.

    Hi there.

    Debt consolidation isn't really something we advise on. Consolidating your debts would mean you would have pay back more than what you owe with the interest. Are you in a position to be able to make an arrangement to perhaps clear the overdraft first (assuming you are not paying interest on the family loan) and then clear the family loan after?

    Alternatively, can you set up a new bank account and set up a standing order to make a payment towards the overdraft each month as well as something to the family loan?
